2.4. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan 2017;
• Planning Regulation 2017;
• Noosa Plan 2020.
2.5. State and Other Statutory Instruments
State Planning Policy
The Noosa Plan 2020 is generally consistent with the State Planning Policy July 2017 (SPP) and
the SPP raises no further issues relevant to the proposed development.
South East Queensland (SEQ) Regional Plan 2017
The site is located within the Regional Landscape and Rural Production Area of the SEQ Regional
Plan. The proposal does not further advance all the goals, elements and strategies of the SEQ
Regional Plan.

domestic and global markets.
While the applicant proposes to incorporate permaculture and food production as part of the
proposal, it is not likely to be of a significant scale.
• An area of 3,500m2 is proposed for use as a syntropic market garden system but produce is
largely intended for the use’s own food source, rather than a viable agricultural activity in its
own right.
• The applicant intends to make improvements to the existing cattle grazing areas, but it is
unclear and there is little detail in the application to suggest this use will substantially intensify
agricultural activities on the land.
• The new development is also clearly more permanent than the golf course, making it harder
for the land to revert to agricultural production in the future, compromising the long-term and
overall rural productivity of the land.
Planning Regulation 2017
The following assessment benchmarks from the Planning Regulation 2017 apply to the application:
• SEQ Regional Plan
• Koala Habitat Area
• Vegetation Management
The South East Queensland Regional Plan includes the site within the Regional Landscape and
Rural Production area. The Planning Regulations 2017 details that any Tourist or Sport and
Recreation is an Assessable Activity and requires referral to the state where is it in a Regional
Landscape and Rural Production area and:
• Results in a gross floor area of more than 5000m2 excluding any part of the premises used
for tourist or employee accommodation
