An intolerable risk is a risk that, following an understanding of the likelihood and consequences, is
so high that it requires actions to avoid or reduce risk. Individuals and society will not accept this
risk and measures are to be put in place to reduce risks to at least a tolerable level.
In an emergency the current proposal depends on a single entry and exit point via Karbi Road to
Cootharaba Road before being able to evacuate either north or south. In an emergency bushfire
situation where evacuation is not an option due to being un-trafficable, the development guests
would be required to shelter in place within the area identified as <10kW/m2.
Given that the proposed use may potentially put large numbers of children in a situation where
they can't be evacuated in an emergency, these guests would have to take refuge on the property
in case of a wildfire emergency and may be exposed to flame attack, ember attack, radiant heat
exposure, wind and smoke attack, convective and conductive heat exposure. Council would view
this as an intolerable risk and don’t believe the development would meet assessment benchmark
3 of the State Planning Policy Guidelines as a result.
The development has also not demonstrated compliance with PO6 (Access and Evacuation
Routes) of the Bushfire Hazard Overlay Code. The development layout does not provide safe
access and egress at all times to all of the development for emergency vehicles and personnel, as
the site is serviced by a single dead-end road with no secondary emergency access available.

that the Rural zone is intended to maintain the capacity of land for rural uses and activities by

(i) Visitor accommodation complements rural uses and promotes the sustainable use of rural
      land.
(p) Development maintains and enhances the significant scenic and landscape values of the

intended for the zone and sensitively responds to the landscape.
