RECOMMENDATION
That Council note the report by the Development Planner to the Environment & Planning
Committee Meeting dated 8 May 2018 regarding representations made to change conditions of a
Development Permit for a Material Change of Use (MCU16/130) for Retail Business Type 6 -
Hardware and Retail Business Type 7 – Garden Centre situated at 101 Eumundi Road,
Noosaville and:
A.   Agree to change condition 8 to read as follows:
     Nature & Extent of Approved Use
     8.    The approved use must not operate outside the hours of:
           a.   7am to 6pm Monday to Friday
           b.   8am to 5pm Saturday to Sunday or any public holiday
B.   Agree to delete condition 7.
C.   Refuse to delete condition 10.
D.   Refuse to amend condition 2 but acknowledge that the plans detailed in the table below
     generally comply with the approved plans of development.

REPORT
1.   PROPOSAL
The applicant has requested a Negotiated Decision Notice for the Development Permit for a
Material Change of Use for Retail Business Type 6 – Hardware and Retail Business Type 7 –
Garden Centre situated at 101 Eumundi Noosa Road, Noosaville and approved on 21 December
2017.
The representations seek to amend conditions 2 and 8 and to delete conditions 7 and 10. The
representations to each of the conditions is discussed under Section 3 of this report.
As part of the representations, a new proposal plan has been provided for which endorsement is
sought. A copy of the approved plans of development and new proposal plans are included in
Attachments 1 and 2.
