Submission under the sustainable planning act 2009 Development permit for material
change of use - service station and reconfiguration of a lot (1 lot into 2 lots), 115 Eumundi-
Noosa Road, Noosaville, QLD 4566.
Application File Number: MCU15/0095 & REC15/0022
Dear Sir/Madam,
I am writing this submission to object to the current proposal for the material change of use of the
above stated address, as I believe it is an inappropriate development for the location based on the
following:
1. LOCATION - Proximity of the development to GSLC school facilities.
The location of the proposed service station is on the boundary of GSLC, abutting directly the HPE
(sports) Center, containing the large sporting hall, HPE teaching staff offices, music and drama
class rooms and gym area (commercially leased to EFM) as well as the school’s open air pool &
smaller learn to swim pool (run through Diamond Swim). These facilities are in consistent daily use
by students, staff and members of the wider community. Due to its size the hall is also used for
school performances, special events and assemblies attended by students, staff and members of
the wider school community. Both school car parks and school bus pick up and drop off area also
directly border the proposed site and have constant vehicular use during peak times (morning and
afternoon) by not only the GSLC bus fleet and families but also those of students traveling on the
local school bus network.
It is disingenuous of the developer to claim that there is separation distance of 100m – the distance
deemed as sufficient to neutralise/dilute benzene particulates - to the school’s classrooms. The
buildings and facilities closest to the proposed development are within 50m of the re-fuelling
canopy and large volume underground fuel tanks. As sport, swimming, music and drama are part
of the GSLC curriculum that makes them by definition classrooms and are in constant use through
out the school day by the school’s students and teaching staff.
Benzene is an internationally recognised human carcinogen (World Heath Organisation), and at its
worst is a known causal factor in the development of leukaemia. Studies state that 100m is the
minimum distance recommended to dilute airborne hazards for the general community and that
those more vulnerable to airborne pollution including children, the elderly and the infirm require a
larger separation distance from the refuelling canopy.
The council has already approved a similar development of a service station on land opposite at
139 Eumundi-Noosa Rd, this development is at a slightly greater distance from the school and it’s
facilities but still posses all the same threats and issues. There is the potential if this development
is approved of creating somewhat of a “double whamy” toxic roundabout.
2. TRAFFIC - Impact of the development on current traffic issues.
The traffic study produced on behalf of by the developer fails to address significant traffic and
safety issues and shows that they have very little, if any local knowledge of traffic flow and
