Further advice
The department offers the following advice to the applicant about the development
application:
- Proximity to buoy moorings: Installation of the restoration unit at Site 5 must ensure
that the unit is located at least 30m away from adjacent permanent buoy moorings.
- Maintenance of aids to navigation:
(a) Noosa Shire Council will be responsible for the installation and maintenance of
aids to navigation associated with the development.
(b) MSQ must approve the intended aids to navigation prior to installation.
(c) MSQ can conduct the works on a cost recovery basis. Please contact MSQ for
further information.
- Resource Allocation Authority: The applicant is advised that the works subject to
this approval require a valid Resource Allocation Authority before works can
commence and while the trial is in progress. Resource Allocation Authorities
(provision of ‘resource entitlement’) are issued under the Fisheries Act 1994.
A copy of this response has been sent to the applicant for their information.
For further information, please contact Tom Kasauskas, Senior Planning Officer, SARA SEQ North
on 5352 9717, or email [email protected] who will be pleased to assist.

Attachment 2—Reasons for decision to impose conditions
The reasons for this decision are:
Coastal protection:
To ensure the development is carried out generally in accordance with the plans of
development submitted with the application.
To ensure the development avoids or minimises adverse impacts on coastal
resources and their values.
To ensure landowners are aware they must take responsibility for their damaged
property as they can impact on coastal resources and public safety.
To ensure demolition of tidal work occurs in a timely fashion and does not
adversely impact on coastal processes.
Development works must comply with the approved plans to avoid unacceptable
impact on coastal values and physical coastal processes. RPEQ signoff indicates
the development is appropriately designed and is structurally sound.
Damaged structures can impact on coastal resources and public safety.
Maritime safety:
To facilitate the monitoring of the development works for compliance purposes.
To facilitate the monitoring of the development works for compliance purposes.
To ensure that at all times, all lights on or above the development site do not
interfere with safe navigation in surrounding waterways.
Fisheries resources:
To ensure development in fish habitats avoid the unnecessary loss or, degradation of fish
habitats or limits fish movement during key seasonal periods.
To ensure the development is carried out in the location and to the extent specified on the
approved plans of development.
To facilitate the monitoring of the development works for compliance purposes.

To ensure the disturbance of acid sulfate soil is managed to prevent impacts on
fisheries resources and fish habitats.
To facilitate the monitoring of the development works for compliance purposes.
To ensure the development does not encroach into fish habitat areas outside the
approved area.
To ensure tidal land profiles are restored to match the surrounding or pre-works
sediment profile to aid re-colonisation by flora and fauna.
