4.0 PROPOSED DEVELOPMENT
This application seeks a Development Permit for Material Change of Use for Multiple Housing Type 2
Duplex to be established in accordance with the accompanying Proposal Plans prepared by Kidd & Co
Designers.

BUILT FORM
The proposed development is three storeys with a maximum height of less than 12m. The building design
is well articulated and includes a variety of design elements, including pitched roofs and eaves. The
proposal achieves a contemporary, architecturally designed development with building articulation and
variation in building materials and treatments. Building materials include metal roof sheeting,
weatherboard cladding, lightweight metal awning and concrete render, and is reflective of the Sunshine
Beach character.

The development proposes one unit per level with a separate double garage on the ground floor for each
unit and is accessible by lift or stairs. Each unit comprises three bedrooms.

ACCESS AND PARKING
Site access is achieved via a driveway from Crank Street. Each unit will be provided with two carparks
contained within the double garages on the ground level. All cars will be able enter and leave the site in a
forward motion.

PRIVATE OPEN SPACE
Each unit includes individual private open space areas. Both units contain separate pools and open space
areas at ground level, with large above ground decks accessible from the living areas.

LANDSCAPING
Landscaping treatments to soften the built form of the proposed development are provided in accordance
with the landscape areas shown on the proposal plans. A landscaped area of 282.6m2 or 55% is proposed.

SERVICING
Provision is made for a general and recycle wheelie bin for each unit. Waste collection will be facilitated
from the street.

INFRASTRUCTURE
The subject site is currently connected to all essential urban infrastructure. Stormwater will be collected
and discharged into a legal point of discharge. Internal water, sewer, telecommunication and electrical
connections will be finalised during detail design.

Key development parameters of the proposal are summarised as follows:

                       Key Development Parameters

6.2 STATE PLANNING POLICY

The State Planning Policy (SPP) defines the Queensland Government’s policies about matters of state
interest in land use planning and development. The SPP only applies to development assessment if the
planning scheme has not yet appropriately integrated the SPP. If there is a discrepancy between a local
planning scheme and a state planning policy, then what is outlined in the state planning policy overrides
the planning scheme.

The Noosa Plan does not reflect the SPP and assessment against the SPP is required.

Part E of the SPP details the interim development assessment requirements for the following state
interests:

7.0 PLANNING SCHEME
Under The Noosa Plan 2006, the site is included within the Eastern Beaches Locality and the Attached
Housing Zone. An assessment of the applicable provisions of The Noosa Plan 2006 has been undertaken
below.

7.1 DEFINITION

The proposed development is defined under the Noosa Plan as:

Multiple housing Type 2 Duplex: Means the use of premises for two dwelling units either attached or
detached, on one lot where the use does not fall under Multiple housing Type 1 Relative or employee.”

Comment: The proposal is for a Duplex in accordance with the above definition.

7.2 LEVEL OF ASSESSMENT

In accordance with the Assessment Table for the Attached Housing Zone, the proposal is identified as a
consistent use and subject to Code Assessment.

7.3 OVERLAYS

There are no overlays affecting the subject site.

7.4 PLANNING SCHEME CODES

In accordance with the Assessment Table for the Attached Housing Zone under the Eastern Beaches
Locality, the following Codes are applicable to the proposed development:

   Eastern Beaches Locality Code;
   Residential Uses Code;
   Landscaping Code;
   Engineering Works Codes;
     o Driveways and Carparking Code
o Transport, Roads and Drainage Code
o Erosion and Sediment Control Code
     o Existing Services Code
     o Earthworks Code
     o Waste Management Code
     o Water Sensitive Design Code

Comment: An assessment of the applicable codes has been included within Attachment 1. Where probable
solutions are not met, an alternative solution demonstrating compliance with the specific outcome is
provided, with the exception of specific outcomes O7 of the Eastern Beaches Locality Code, relating to site
cover. The following sections detail the alternative solutions and outcomes provided, including sufficient
planning grounds to justify the conflict with the specific outcome.

7.4.1 ALTERNATIVE SOLUTIONS

Eastern Beaches Locality Code – O5 – S5.1 – Setbacks

Alternative Solution: In accordance with schedule 1 the development is required to have a frontage
setback of 6m for the first two stories and 10m for the third storey. The proposal provides for a ground
level setback of approximately 15m, with the second and third storey setback 7.5m. This largely results in
an averaging of the required setbacks and which we understand Council has previously accepted for 3
storey residential development.

Required side setbacks, based on wall heights ranging from 7m – 10.9m, vary from 2m to 3m. The
northern side boundary setbacks vary from 2.3m to 3m and the southern side setbacks vary from 2.6m to
3m. While these setbacks do not fully comply, they generally comply and with the wall length articulation
provided, result in an acceptable setback solution. A reduced setback of about 1.2m is however required
for the ground level garage to the northern boundary. As the wall height of the garage is only 2.4m, it is
not considered this reduced setback will result in any detrimental impact on the adjoining property, which
is an undeveloped and heavily vegetated property.

The required rear setback is 6m, with the development providing a minimum rear setback of about 4.8m.
The rear building elevation does not however present in a single plane and is highly articulated. Given the
sites topography and the existing developed form of the adjoining property to the rear, this varied rear
setback will not result in any detrimental impact.

In accordance with specific outcome O5 and in consideration of the above, the above noted setbacks are
considered to be adequate to provide amenity for occupants of the development and ensure amenity is
maintained for adjoining land uses; provide adequate distance from adjoining uses; allows for landscaping
to be provided between the proposed development and adjoining land uses; and will maintain the visual
continuity and pattern of buildings and landscape elements of the street. The setbacks comply with specific
outcome O5.

Eastern Beaches Locality Code – O13 – S13.2 & S13.3 – Sloping Sites

Alternative Solution:
While the building is not split level design and part of the proposal will result in cut exceeding 2m in
height, the building has been designed in accordance with O13 to be responsive to the natural topography
of the site, minimise cut and fill and not visually dominate the hill slope or interrupt the skyline. The area
of cut exceeding 2m relates to the ground level carparking which is in part semi-basement form. The
garages are integrated into the site with the surrounding finished site levels relating to natural ground
topography and not showing significant cut.

Eastern Beaches Locality Code – O13 – S13.5 – Sloping Sites

Alternative Solution:
The building presents as 3 storeys to the street frontage as allowed for by specific outcome O4.

Residential Uses Code – O17 – S17.1

Alternative Solution:
While the building is not split level design and part of the proposal will result in cut exceeding 2m in
height, the building has been designed in accordance with O17 to to maximise the use of the natural
topography and minimise the need for cut and fill. The area of cut exceeding 2m relates to the ground

level carparking which is in part semi-basement form. The garages are integrated into the site with the
surrounding finished site levels relating to natural ground topography and not showing significant cut.

7.5 PLANNING SCHEME CONFLICTS

The assessment of the proposed development against The Noosa Plan has determined that the only
potential conflict with the planning scheme is with specific outcome O7 of the Eastern Beaches Locality
Code in relation to site cover.

Eastern Beaches Locality Code – O7 – Site Cover

Specific outcome O7 requires for the Attached Housing Zone that site cover does not exceed 35% in
Sunshine Beach or 40% otherwise. It is apparent that this is intended to limit the potential impact of
attached housing development within Sunshine Beach which has a 3 storey/12m height limit, compared to
other areas which have a 2 storey/8m height limit.

In this regard the proposed development provides for a site cover of 35% for that part of the building
above ground level, with only a minor exceedance at ground level for garage roofing (12m 2) which
increases the site cover to 37%. This 12m 2 or 2% exceedance is considered minor and when the context
of the exceedance being limited to a ground level built form of less than 3m in height is taken into
account, it is evident that overdevelopment is not contemplated. This outcome is less than the maximum
40% site cover provisions for development not exceeding 2 storeys in other areas.

This outcome is also supported by specific outcome O6 which provides The site cover, gross floor area
and plot ratio of buildings and other roofed structures – a) results in a building scale that is compatible
with surrounding development. The proposed development will remain consistent with this outcome.

In the circumstances, it is suggested that to the extent that there is any conflict with the planning scheme
it must be minor or of a technical nature only.

8.0 CONCLUSION
This Development Assessment Report has been prepared on behalf of Bain and Butt Superfund to support
a Development Application for Material Change of Use for Multiple Housing – Type 2 Duplex in respect of
land at 6 Crank Street, Sunshine Beach, described as Lot 431 on RP48112.

The site is included under the Noosa Plan within the Eastern Beaches Locality and the Attached Housing
Zone. The proposal is subject to code assessment.

Planning support for the proposal is justified on the following grounds:

   The proposal is a consistent use under the Noosa Plan 2006;
 The proposal generally complies with all provisions of the Noosa Plan 2006 and the applicable codes.
Where the probable solutions of the codes are not met, an alternative solution demonstrating
compliance with the specific outcome has been provided. While a minor noncompliance with a specific
outcome relating to site cover results, sufficient planning grounds are provided to justify the use
    despite the conflict;
 The proposed development is consistent with surrounding uses and can be achieved with no
detrimental impact on the existing streetscape or neighbourhood amenity; and
 The built form, design and density proposed is compatible with the existing character in the locality.

Approval of the proposed Duplex is warranted.
