GENERAL COMMITTEE MEETING AGENDA 14 JANUARY 2019
in truck numbers and as at the time it was understood that the road upgrade works were generally
complete. Infrastructure Services have since advised that although some minor works were
undertaken those detailed in the approval have not been completed.
Advice from Council’s Infrastructure Planning Design and Delivery team is that the type of works
required to be undertaken will be captured under the priority programs for narrow sealed roads. At
this stage the required works are currently not scheduled.
At the time of the original application the cost of the required road works were assessed as follows:
• 1380m of full road reconstruction (estimated cost $690,000); and
• 250m of 7m wide overlay (estimated cost $26,000).
This results in a total estimated cost of $716,000 for the road improvements to Cooroy Mountain
Road.
Based on the percentage of vehicles attributable to this business from their consultant’s traffic
study and Council’s own traffic count adjacent to the business, it was considered appropriate at
the time to charge in accordance with the following percentages. The fact that there was a
wreckers/salvage yard also using a section of the road was taken into account.
The applicant was charged at a rate of 12.5% of the cost of the first 710m of reconstruction at the
western end of the road section ($44,375). For the section from the east of the wreckers/salvage
yard to the business site the applicant was charged 32.3% of the cost of the remaining works
($116,600). In addition there was a contribution of $5,960 towards the road network of Cooroy
Township.
Council’s Infrastructure Planning Design and Delivery team have advised that these costings are
still relevant today.
The amended approval given in January 2015 also resulted in a change to conditions 8 and 9
regarding access, removing the requirement to relocate and upgrade the existing access. The
amended access requirements were supported due to the reduction in truck movements to the
site. Upgrading works to the existing access required by the amended conditions have not been
undertaken.
The amended approval also included changes to the hours of operation, staff numbers, required
car parking and effluent treatment requirements to reflect the proposed downsizing of the scale of
the business.
Attachment 2 represents the current development approval.
2.2. Complaint History
The previous operation of Cooroy Mountain Spring Water had an extensive history of complaints
spanning almost 10 years. Generally speaking, the complaints began as the development
expanded from an approved home based business to a much more substantial industrial operation
and the majority of complaints related to traffic generation. The complaints resulted in various
breach actions being pursued by Council and also the lodgement of the application that led to the
current development approval.
More recently complaints have been received in relation to B-Double trucks attending the site in
contravention of the existing approval. The complaints were primarily concerned with the impact
on the amenity of residential properties along the truck route and the impact on the safety of road
users.
The operator advised that the B-Doubles were being used by a new contractor who was sourcing
water from the site and has now rectified this aspect of non-compliance with the approval.
2.3. Site Description
The subject site is a rural property of approximately 48 hectares in area and contains the Cooroy
Mountain Water bottling plant. A detached house is also situated on the site and the remaining
