RECOMMENDATION
That Council approve applications No. 51997.2384.03 (12506 TC) & 132009.1102.03 (09/1102)
requesting changes to existing development approvals for Material Change of Use (Multiple
dwellings (115 units), shops, restaurants, outdoor dining areas and ancillary facilities), situated at
32 Hastings St Noosa Heads, in accordance with the following:
A.    Change the approval description/type for 132009.1102 to Entertainment & Dining Business
      - Type 1 (Food & Beverages).
B.    Change Condition 1 (of 132009.1102) and Condition 38 (of 51997.2384) to read as follows:
      Condition 1
      Development undertaken in accordance with this approval must generally comply with the
      approved plans of development. The approved plans are listed in the following table and as
      may be amended by these conditions.

      Condition 38
      Outdoor dining areas shall be limited to those areas shown on approved Plan No. D-
      C01376-01-B titled “Proposed Additional Exclusive Use Areas” drawn by Martoo Consulting
      Pty Ltd dated 29/01/2013.
C.    Include an additional Condition to 51997.2384 to read:
      The existing “green wall” garden beds that have been established in the locations identified
      as “Existing Vertical Green Wall” and “Proposed Vertical Green Wall” on approved Plan No.
      D-C01376-01-B titled “Proposed Additional Exclusive Use Areas”, shall be maintained in
      good condition, with plants of poor health replaced when required.
D.    Amend the list of Approved Plans.
E.    Agree to Execute the associated Infrastructure Agreement for Contributions in Lieu of On-
      Site Parking Spaces, prior to the issue of the Decision Notices.



REPORT
1     PROPOSAL
The application seeks approval for a Permissible Change to two existing development approvals
for the Laguna on Hastings development. The requested changes involve a change of use from a
shop to a restaurant for one tenancy and increases to designated onsite outdoor dining areas,
retail display areas or utility areas of three commercial tenancies that surround a common
courtyard/plaza area. Details of the commercial tenancies and the proposed changes are
detailed below. Note all areas described are within the site and are not footpath dining or the like.
