REPORT
1.    PROPOSAL
The application seeks approval to change conditions of approval and extend the relevant period
of the 1 into 2 lot subdivision. The applicant requests:
 Changes to conditions 10, 11, 13 and 29 of the approval that applicant submits are not
      required or are in conflict with a later Material Change of Use approval for a detached
      house issued for the site; and
 Extension to the relevant period of the approval by 4 months.
In support of the changes the applicant’s consultant submits:
The applicant has been progressing with the subdivision approval (2006/862), has lodged an
application for operational works, received approval and paid the relevant bond. However,
following approval of the subdivision approval Council notified the applicant that the Development
Approval for the dwelling (MCU11/0204) was not consistent with conditions of the subdivision
approval. In this regard the conditions of the subdivision approval state that the locations of future
dwellings are to be outside the mapped Remnant Vegetation, whereas the Material Change of
Use approval approves a dwelling within the mapped vegetation area.
The applicant also requests an extension of the currency period for a further four (4) months
based on the following.
 The applicant has been progressing with subdivision approval as evidenced by the
      submission and subsequent approval of the relevant operational works application for the
      development;
 The site was listed for possible purchase by Sunshine Coast and the applicant delayed the
      commencement of the subdivision waiting for confirmation of Council purchase before
      proceeding with the subdivision. The new Noosa Council advised that they were not
      interested in purchasing the site and hence the applicant has proceeded with the
      development;

                                                                                     Page 29 of 155
