EXECUTIVE SUMMARY
The Adopted Infrastructure Charges regime commenced on 1 July 2011 and replaced all
previous contributions and charges regimes applying to new development. The State
Government’s recent review of the adopted infrastructure charges regime and priority
infrastructure planning introduced amendments to the Sustainable Planning Act 2009 that
commenced on 4 July 2014.
This report provides Council with a summary of the major changes and the subsequent actions
required to be undertaken to satisfy the amended legislation.
RECOMMENDATION
That Council note the report by the Infrastructure Assessment Officer to the Planning &
Organisation Committee Meeting dated 19 August 2014 and:
A. Resolve to undertake an amendment to the Priority Infrastructure Plan in accordance with
the recent amendments to the Sustainable Planning Act 2009 and corresponding new
Statutory Guideline 03/14;
B. Request staff to prepare an amendment to Council’s Infrastructure Charges to satisfy the
Sustainable Planning Act 2009 for presentation to a future Council meeting; and
C. Request the Chief Executive Officer to negotiate with Unitywater regarding a simplified
infrastructure “charges breakup” agreement applying a weighted average demand
approach for inclusion in the future amendment to Council’s Infrastructure Charges.
REPORT
The State Government’s review of “trunk” infrastructure planning and infrastructure charges has
been an ongoing process for many years. Adopted Infrastructure Charges commenced on 1 July
2011 as a temporary measure replacing all former Council infrastructure contributions policies
and infrastructure charges plans applying to new development. It was intended that further State
Government reviews would provide a new and long term infrastructure charges regime to be in
place by 1 July 2014.
The “Sustainable Planning (Infrastructure Charges) and Other Legislation Amendment Bill 2014”
was released for a limited consultation period in May 2014 and Council provided a
comprehensive submission to the State on 15 May 2014. Some changes were made to the Bill
before being passed by Parliament on 19 June 2014 as the “Sustainable Planning (Infrastructure
Charges) and Other Legislation Amendment Act 2014” with the amendments to the “Sustainable
Planning Act 2009” (SPA) having commenced on 4 July 2014.
