PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 19 AUGUST 2014
These amendments have resulted in Council’s charge notice increasing from 2 to 6 pages.
5. Permissible Changes and Extension Approvals
The amended legislation now extends infrastructure charges to applications to change an
existing approval and to an extension of relevant period. However, the amendments are limited in
that they only allow for an amendment to a charge notice where one was previously issued on
the original approval.
No consideration has been made regarding applications which relate to old approvals that only
contained infrastructure contributions for limited or no infrastructure networks, and therefore the
current process will need to continue. This means:
for applications to change an existing approval, continuation of those infrastructure
contribution conditions applied in the original permit and capture missing networks through
the building approval process if applicable; and
for applications to extend the relevant period, continue Infrastructure Agreements to be
entered for missing networks.
6. Trunk Infrastructure Definition
An amendment has been made to the definition of ‘trunk infrastructure’. Previously, trunk
infrastructure was development infrastructure identified under a PIP or adopted infrastructure
charges resolution. If development infrastructure is not trunk infrastructure then it is by default
‘non-trunk infrastructure’.
Under the amended Act, trunk infrastructure is infrastructure identified in an LGIP and also
development infrastructure that, because of a conversion application (a new item explained
below), becomes trunk infrastructure. In addition, development infrastructure that is required to
be provided under a condition relating to delivery of necessary trunk infrastructure becomes trunk
infrastructure by definition.
7. New Definition of Establishment Cost
The establishment cost for existing trunk infrastructure now means the current replacement cost
of the infrastructure as reflected in the relevant local government’s asset register, and the current
value of the land acquired for the infrastructure.
The establishment cost for future infrastructure includes all costs of land acquisition, financing,
and design and construction, for the infrastructure.
The methods for determining establishment costs must also comply with the Statutory guideline
03/14.
8. Offsets and Refunds
The amended Act requires Council to specify in its infrastructure charges resolution the method
for working out the costs of trunk infrastructure that is conditioned to be provided by
development. Also, any offset is now required to be against the total charge issued and not
limited to a specific trunk network.
The offset & refund must now also be stated in the infrastructure charge notice (ICN) when first
issued, so in order to meet the timeframes required by the Integrated Development Assessment
System (IDAS), the PIP planned estimate will need to be the default amount used to determine
the establishment cost of the infrastructure item for the offset amount.
