22. Biodiversity and vegetation protection
Amendments are proposed to the Biodiversity Overlay Code to incorporate vegetation protection
requirements into the planning scheme from the now expired Temporary Local Planning
Instrument (Vegetation Protection Overlay). These amendments mean that tree clearing activities
that are not otherwise exempt and that sit outside the Biodiversity Overlay mapped areas would
be assessed to determine whether they are reasonably necessary and whether they would
adversely impact on ecological important areas, riparian vegetation, visual buffers, scenic
amenity, water catchment areas, cultural heritage, or a person or industry reliant on maintaining
the vegetation.
There is concern that the incremental loss of vegetation over time will erode important shire
values unless there is a mechanism in place that can ensure that reasonable and necessary tree
clearing occurs and that compensatory plantings are provided as part of tree clearing approvals.
