Subject: Submission in response to Planning Application MCU19/0054

To Whom It May Concern,

Noosa Shire Council Planning Department and Noosa Shire Councillors.

Having reviewed the proposed material change of use development application MCU19/0054 2-18 and 20 Hofmann Drive I’d like to submit my objection to the application. The change of use proposed is manifestly non-compliant and out of kilter with the use deemed most appropriate for the benefit of the community when council determined the existing as of right permitted use for the land.

The developer hopes to secure approval for a development that bears little resemblance to that approved under the current planning scheme. One can only assume that Noosa Shire Council had a vision for Noosa and this particular parcel of land when endorsing and implementing the town plan. I’d respectfully request that council maintains that vision not granting any component of the application for a material change of use given the lack of consideration the applicant has given to the amenity of the precinct and the wishes of both council and the community.

Material Change of Use for Undefined Use pretty much sums it up given approval of this application (with or without restrictions) would allow almost any and every conceivable use (undefined) within the development which in turn would significantly and negatively impact many individuals and businesses within the community in many ways.

Where do you start?

Height – way over the top. Does the developer have a total disregard for Noosa Shire Councils height restrictions? Existing building height restrictions are what differentiates Noosa from the southern end of the Sunshine Coast. Is this what developers do, asking for more than they could ever hope to secure approval for so that when they give a little during future negotiations with council they end up with what they wanted in the first instance stating they have made major concessions? One has to wonder what if any consultation with council was taken prior to submission of this planning application? Surely this hasn’t been submitted with an expectation of support from our elected council representatives. I hope not.

Traffic – major congestion. Assuming the car parking is sufficient for this large scale development the surrounding traffic network and infrastructure has not been designed to accommodate the volume of traffic, approval for the inappropriate over-development of this site, will potentially attract. Worse still, in the event that car parking allocated is insufficient there is no provision for overflow parking leading to further congestion. It would appear to me that there are significant safety issues turning into the developments proposed secondary carpark off Hoffman Drive directly across oncoming traffic. If the small roundabout proves inadequate it would be of concern were traffic lights required to resolve issues related to traffic concerns. I’d hope that council doesn’t approve a development that likely needs this level of traffic control whether initially or in the future. There are proposed uses given the bulky goods and major retail component of the development that will require delivery by heavy vehicles. It would appear that there is no specific exclusive entry and exit of heavy vehicles without these passing through the general customer parking bays, a further safety concern.

Council has previously blocked applications for rezoning of land and extensions to the Noosa Civic Shopping Centre with direct access from Sunshine Coast motorway. Approval of a development of this magnitude on land within close proximity of what is for all intents and purposes an industrial area seems totally inappropriate. This development if approved will be nothing more than another retail shopping precinct, medical hub (when we already have ample suitably zoned land for such a use) and “high rise” featuring brightly coloured retail outlets with entire buildings painted red and blue or yellow and red and isn’t the desired look and feel I’d expect council or residents of Noosa want or need. Trees will only hide so much.

I believe earlier zoning for use of the site as a Masters development site only came about as a result of the then developer taking court action and shouldn’t be presented by Urbis or the developer as councils prior endorsement of that approval.

Hold firm Noosa Council, reject this application advising Spotlight and their advisors to go back to the drawing board designing a complex that is in keeping with the expectations and needs of the community and in keeping with Noosa Shire Councils plans for future development and growth as evidenced by the current zoning. What a waste of time, energy, community consultation and rate payers money if council was to approve such a significant change of intended use for this parcel of land. Please don’t approve a pseudo shopping centre precinct that will simply replicate many of the existing retail business, health and other services already provided and readily available here in Noosa. Many of these businesses wouldn’t survive were this application to be approved given the proposed scale of the development and resultant over supply of like retail, health and service providers.

Yours faithfully,

Clint Coker
