1.0 INTRODUCTION
North Coast Environmental Services have been engaged to provide a Bushfire Attack Level
Report in accordance with Australian Standard 3959 (2018) Construction of buildings in bushfire-
prone areas. The Bushfire Attack Level (BAL) assessment was requested to assess the National
Construction Code construction requirements for a proposed new dwelling within Lot 17 on
RP903874, located at 268 Kinmond Creek Road, Cootharaba (herein referred as ‘the site’).
2.0 LEGISLATIVE TRIGGER
The National Construction Code 2019 (Amendment 1) dated July 2020, Performance
Requirement P2.7.5 Buildings in bushfire prone areas states:
A Class 1 building or a Class 10a building or deck associated with a Class 1 building that is
constructed in a designated bushfire prone area must, to the degree necessary, be designed and
constructed to reduce the risk of ignition from a bushfire, appropriate to the —
(a) potential for ignition caused by burning embers, radiant heat or flame generated by a bushfire;
and
(b) intensity of the bushfire attack on the building.
Under NCC 2019 Amendment 1 July 2020, Section 3.10.5.0 Application states:
(a) Subject to (b), Performance Requirement P2.7.5 is satisfied for:
• A Class 1 building; or
• A Class 10a building or deck associated with a Class 1 building
located in a designated bushfire prone area if it is constructed in accordance with –
• AS3959; or
• NASH Standard – Steel Framed Construction in Bushfire Areas.
(b) The requirements of (a) do not apply when, in accordance with AS 3959, the classified
vegetation is Group F rainforest (excluding wet sclerophyll forest types), mangrove communities
and grasslands under 300 mm high.
In accordance with the definition in the NCC, a designated bushfire prone area in Queensland
means:
• land which has been designated under a power of legislation as being subject, or likely to
be subject, to bushfires.
2.1 Noosa Council Bushfire Hazard Overlay Map
The Bushfire Hazard Overlay Map of the Noosa Plan 2020 identifies that the site is affected by a
High Bushfire Hazard Area and Potential Impact Buffer (refer to Plate 1). The proposed new
dwelling is to be located within the High Bushfire Hazard Area.

5.0 AS 3959:2018 BAL ASSESSMENT
AS 3959:2018 provides minimum construction requirements for assessable building works in
Designated Bushfire Prone Areas. Dwellings (and renovated parts of existing dwellings) in
Designated Bushfire Prone Areas must be built to the BAL construction standard relevant to the
dwelling as identified by AS 3959:2018.
5.1 Methodology
The BAL identified herein has been determined by using the normative procedure described in
Appendix B (Method 2) of AS 3959:2018. Table 2 describes the general steps used under AS
3959:2018 to determine the BAL.
Table 2 – Methodology
Step Clause Procedure
1 2.2.2 Determine the relevant fire danger index.
2 2.2.3 Determine the classified vegetation type(s)
3 2.2.4 Determine the distance of the site from the classified vegetation type(s)
4 2.2.5 Determine the effective slope(s) under the classified vegetation type(s)
5 2.2.6 Determine the BAL from the appropriate table (Flamesol model used).
6 2.2.7 Determine the appropriate construction requirements.
Quantitative modelling of the potential bushfire conditions that may be experienced within the
Type A Forest vegetation located surrounding the location of the proposed dwelling has been
undertaken to identify the BAL acting on the works. The FLAMESOL Minimum Distance calculator
has been used to ascertain the BAL dimensions and comprises an AS 3959:2018 Method 2
(Appendix B) based calculator. The following input data was used to determine the BAL based
on the conditions observed during the site inspection in January 2021 and the plans presented
for assessment (refer to Table 3).

The proposed dwelling, in the absence of further vegetation clearing approval, is assumed to be
seperated by a maximum of 10m to Type A Open Forest classified vegetation in all directions.
10m exempt clearing is afforded to dwellings on Category 3 Lots (>2ha not in protected vegetation
overlay area) and Category 4 Lots (>2ha and <10ha in protected vegetation overlay area) under
the defintion of Exempt Clearing (Clause (g)) in the Noosa Plan 2020. The Lot is assumed to be
a Category 3 lot. Therefore, in accordance with Table 4 the dwelling is exposed to BAL FZ.
An application for additional vegetation clearing can be made to NSC to increase the separation
distance hence lower the resultant BAL acting on the building. The extent of proposed vegetation
clearing should be identified on the proposed building plans. Generally, NSC is amenable to
approving vegetation clearing to secure no less than BAL 29.
5.3 Vegetation Management
The vegetation between the dwelling and the adjacent edge of the hazardous vegetation must be
maintained as low threat vegetation in order for the BAL ratings to be valid and to maintain these
BAL ratings into the future.
Vegetation conditions within the setbacks attributable to each BAL must comprise low threat
vegetation as per the definition prescribed in the Standard in order for the BAL construction
standards to be effective as intended. Clause 2.2.3.2 (f) of the Standard defines Low threat
vegetation as:

Bushfire Attack Level Report v1 NCES REF: J000756 Lot 17 on RP903874 – 268 Kinmond Creek Rd, Cootharaba 6.0 CONCLUSION The dwelling proposed to be constructed at 268 Kinmond Creek Road, Cootharaba, has been assessed as being exposed to BAL FZ. BAL FZ is primarily concerned with protection from flame contact together with ember attack and radiant heat of more than 40 kW/m2. Construction in BAL FZ may require reliance on measures other than construction. The requirements for construction of a building in BAL FZ may be regulated by the building authorities having jurisdiction in the States and Territories of Australia. A building assessed as being BAL FZ shall comply with Section 3 and Clauses 9.2 to 9.8 of AS3959:2018 and have a minimum setback of 10m from the edge of the classified vegetation. There are a number of Standards that specify requirements for construction; however, where AS3959 2018 does not provide construction requirements for a particular element, the other Standards apply. Any element of construction or system that satisfies the test criteria of AS 1530.8.2 may be used in lieu of the applicable requirements contained in Clauses 9.2 to 9.8 of AS 3959 2018. An application for additional vegetation clearing can be made to NSC to increase the separation distance hence lower the resultant BAL acting on the building. The extent of proposed vegetation clearing should be identified on the proposed building plans. Generally, NSC is amenable to approving vegetation clearing to secure no less than BAL 29. Table 4 should be used to determine necessary separation distances in each direction to achieve lower BAL ratings. In accordance with AS3959, the most severe BAL assigned to an elevation is to be assigned to the entire dwelling. All queries regarding building materials should be discussed with the architect and/or building designer and confirmed to be compliant with the requirements of the AS 3959:2018 by a registered building certifier. © 2021 9
