Author: Karina Birch File / Ref number: 2022/001280 Directorate / Unit: Land and Surveying Services Phone: 3330 4305 1 July 2022 Queensland Government Freeman McGrath Department of Resources Long View Consulting Engineers PO Box 963 COOROY QLD 4563 Dear Freeman REQUEST FOR AN OWNERS CONSENT FOR A DEVELOPMENT APPLICATION FORA PRESCRIBED TIDAL WORKS TO REPAIR EROSION OF THE TIDAL EMBANKMENT - LOCATED AT 172 GYMPIE TERRACE, NOOSAVILLE Reference is made to your request dated 21 April 2022 for owners consent required for a development application for a prescribed tidal works to repair erosion of the tidal embankment. The proposed works refers to reconstruction of the existing failed revetment wall, stabilization of eroded backfill and foreshore terrace subgrade soils located at 172 Gympie Terrace, Noosaville described as Lot 164 on CP907410 being term lease 0/238031. The department hereby gives owner's consent to accompany the development application for the purpose of section 51(2) of the Planning Act 2016 for a prescribed tidal works located at 172 Gympie Terrace, Noosaville. Consent is given on the basis of the comments provided by the following agencies: Department of Agriculture and Fisheries Fisheries Queensland advised on 7/06/2022 that they have no objections to the provision of owners consent to undertake the construction of a replacement revetment wall and stabilization works on Lot 164 on CP907410, Gympie Terrace, Noosaville. , The above comments do not give approval for development that is: e The removal, destruction or damage of marine plants; or e Constructing or raising of waterway barrier works. Nor do these comments provide a resource allocation or entitlement where one is required. Please refer the applicant to the Department of Agriculture and Fisheries (DAF) factsheets below in relation to the proposed revetment works and what may or may not constitute waterway barrier work. : What is a waterway barrier work? What is not a waterway barrier work? Postal Address: Telephone: 3330 4305 Department of Resources Land Services PO Box 15216 CITY EAST QLD 4002
Page 20
It appears that operational works for the proposed revetment wall and bank stabilisation may impact on marine plants. Under the Planning Regulation 2017, works involving the removal, destruction or damage of marine plants must be undertaken in accordance with the relevant accepted development requirements (ADR) or under a development approval (assessable development). The proposed works may comply with the ADR if the impact to marine plants can meet a prescribed work type. If the works cannot meet a prescribed work type, then a development approval will be required for assessable development that is the removal, destruction or damage of marine plant. Please refer the applicant to DAFs webpage, protection and management of marine plants for more information. Department of Environment and Science (DES) Department of Environment and Science advised that they have no objections to the issue of owners consent. The following additional advice is recommended to be submitted to the proponent for any subsequent development application: e Revetment walls are defined as an erosion control structure and considered as coastal protection works. e Submission of adequate documentation and compliance with the SDAP State code 8 will be a requirement for assessable development under the Planning Act 2016. Please refer to the Guideline: State Development Assessment Provisions, State Code 8: Coastal development and tidal works https://environment.des.qid.gov.au/coastal/development/pdf/state- code8-coastal-development-tidal-works.pdf in responding to State Code 8. The guideline provides background information and key concepts relevant for coastal processes and resources and coastal protection and management applicable to complying with the code. The guideline also contains information on how to respond to particular performance outcomes (PO) and specific information requirements. Revetment walls are generally only supported by the State under Performance Outcome PO11 & PO12 of the State code 8 when there is an imminent threat to significant buildings or infrastructure, and there is no feasible option for either: a. beach nourishment; or b. relocation or abandonment of structures; Revetments differ to other erosion control structures in that they are designed to protect a specific part of land, often defined by lot boundaries and provide a very high certainty of protection. A smooth alignment of revetments along a coastline and riverine system is important to ensure the impact on coastal processes is minimised. The preferred hierarchy of responses to erosion risk applies to revetments just as it does for other erosion control structures. Noosa Shire Council has endorsed a Shoreline Erosion Management Plan (SEMP) that has been supported by DES, the recommendations of that plan are the preferred approach for deciding the location and design of coastal protection works. Please check with Council’s SEMP regarding preferred methodology for erosion control structures along the Noosa River. Although owner's consent for the development or change application has been provided, your client is always required to comply with the purpose, terms and conditions of Term Lease 0/238031 — Lot 164 on CP907410 and undertake works only if and when the development has been approved by the assessment manager or responsible entity, and in accordance with the conditions of that approval. Page 2 of 3
Page 21
A copy of this letter is to be attached to your DA Form 1 as the required evidence of owners consent. Your client will also need to comply with all other legislative and regulatory requirements which may also include approvals that are not part of the assessment of the development application under the Planning Act 2016 e.g. a marine park permit if in a marine park. Further, please note that the above consent will expire on 2 January 2023. Should the development application not be lodged with the assessment manager prior to this date, your client will be required again to lodge the DA Form1 and any attachments with this Department with a further request for owner's consent - any further request will need to be reconsidered by the Department. It is also advised that any land use activities must comply with the Aboriginal Cultural Heritage Act 2003 or the Torres Strait Islander Heritage Act 2003. Finally, owner’s consent is required under the Planning Act 2016 to enable the application to be considered properly made for lodging with the assessment manager and is a completely separate process to assessment of the application under the Planning Act 2016. Accordingly, the State may act at a later date as assessment manager in the assessment of the development application - providing owner’s consent will not influence any role the State may have in this development assessment.
