24255 GIA Request
24 July 2025 Our Ref: 24255 Council Ref: MCU24/0144 NOOSA COUNCIL PO BOX 141 TEWANTIN QLD 4565 ATTENTION: The Chief Executive Officer VIA EMAIL: [email protected] Dear Sir, MCU24/0144: GENERALLY IN ACCORDANCE REQUEST: DEVELOPMENT PERMIT FOR MATERIAL CHANGE OF USE TO ESTABLISH MULTIPLE DWELLINGS 27 MYALL STREET, COOROY, QLD, 4563 LOT 27 ON C5605 On behalf of the applicant, Seaside Property Trust, we write to formally request Council’s consideration that the proposed amendments to the approved development plans for 27 Myall Street, Cooroy be deemed generally in accordance with the Development Permit for Material Change of Use (MCU24/0144) for Multiple Dwellings. As part of detailed design and in response to post-approval review of conditions and external agency advice, several minor modifications are proposed. These are summarised below and supported by updated plans and technical documentation where applicable. • Attachment 1 – Landscape Concept Plan Package, prepared by Project Urban; and • Attachment 2 – Acoustic Report, prepared by acousticworks. The proposed changes are considered to be generally in accordance with the current approval, and we ask Council to endorse the amended plan as being part of that approval. The request involves an amended Landscape Concept Plan Package to meet the specific acoustic requirements of the SARA conditions. An amended Landscape Concept Plan is provided in Attachment 1. This has been prepared in response to the development approval conditions from SARA, specifically Condition 4 relating to acoustic fencing. The updated plan incorporates minor amendments, including the addition of a 2.2m high acoustic fence along the site frontage and eastern boundary of Unit 1 and a new 2m wide landscaped buffer in front of the fence. These amendments enhance acoustic and visual amenity outcomes without altering the approved development layout or intensity. The changes are considered to be generally in accordance with the approved plans. An Acoustic Report prepared by Acoustic Works (Attachment 2) has been provided in response to SARA Condition 4. The recommendations include: • Construction of a 2.2m high acoustic fence to the front boundary and side of Unit 1;

• Implementation of window and internal layout treatments to mitigate road noise
impacts.
The proposed fencing arrangement at 27 Myall Street, Cooroy, is considered to be generally
in accordance with the development approval, notwithstanding minor differences with the
provisions of Condition 16 relating to front boundary fencing. The proposed fencing responds
directly to the requirements of the State Assessment and Referral Agency (SARA) condition,
which overrides the Council-imposed condition in this instance. While the Council condition
seeks an average 1.0 metre setback and limits solid front fencing to 1.2 metres unless of open
construction, the proposed design is consistent with the SARA condition and maintains a high
standard of presentation to the street. On this basis, the proposal remains consistent with the
intent of the original approval and warrants endorsement as being generally in accordance
with the approved plans and conditions.
These changes are now reflected in the updated landscape plans and do not alter the approved
development layout or increase impacts on surrounding properties.
The proposed changes are minor, maintain compliance with relevant conditions and the
planning scheme, and do not materially alter the approved form, use, or intensity of the
development. On this basis, we respectfully request that Council consider the changes as
generally in accordance with the approved plans under MCU24/0144.
We understand that a fee of $793.00 applies to this request, and this will be paid upon receipt
of Council’s invoice and reference number.
Should you have any questions with respect to the above, please do not hesitate to contact
me direct.
Yours faithfully
