PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 DECEMBER 2020

The planning scheme seeks that businesses do not

4. CONCLUSION & REASONS FOR DECISION
The planning scheme clearly seeks that commercial operations are not expanded and operate
from within the existing lease areas. The planning scheme also seeks to avoid an increase in gross
floor area and site cover of commercial businesses on the Noosa River to limit the commercial
operations on the Noosa River given it is a highly popular recreation area. There is a direct
relationship between the size of the building and the scale and intensity of the business that can
operate from it.
While the proposal to enclose a portion of the front deck and a small portion at the rear of the
building is minor in some respects, it has the potential to increase the scale and intensity of the
existing hire business which is considered to be already operating beyond the capacity of the lease
area. This is supported by the number of infringements Council has previously issued to the
business for operating outside their lease area.
Given the proposal is increasing the gross floor area and has the potential to increase the scale
and intensity of the use, the proposal conflicts with the relevant outcomes of the planning scheme
and is recommended for refusal.
