        ATTENTION: Patrick Murphy

Dear Patrick,

REPRESENTATIONS ON DECISION NOTICE - MCU21/0033

31 BOTTLEBRUSH AVENUE, NOOSA HEADS
LOT 16 ON RP88934

Further to Council’s Decision Notice issued for the above development application, we make the
following representations in regards to Council’s approval.

Condition 20
Condition 20 currently reads as follows:

“To protect privacy between adjoining properties, the decks located on Level 2 and Level 3
must include batten screening of a height of not less than 1.7 metres above finished floor
level, generally in accordance with the Approved Plans, positioned in such a way to obscure
direct views into the habitable room windows or private open space areas of the adjoining
        properties, and must include:”

We understand that the words “and must include:” were left in the final decision notice by mistake and
we therefore request that they be deleted as shown above.
Condition 21
Condition 21 currently reads as follows:
“Where windows overlook or have the potential to overlook the private open space of nearby
properties or view into habitable room windows within 10 metres
           a. windows are to have a sill height of not less than 1.7 metres above finished floor level;
                and
           b. windows and doors use translucent glazing to obscure views.”

Whilst the need to protect the privacy of adjoining residents is acknowledged we are concerned that a
requirement to provide minimum window sill heights of 1.7m will have an adverse impact on the quality
of some of the internal spaces within the approved buildings. In order to address this issue we would
suggest that the condition be amended as shown below. Please note that any new text is shown in bold
and any text to be removed is struck through:
“Where windows overlook or have the potential to overlook the private open space of nearby
properties or view into habitable room windows within 10 metres:-
           a. windows are to have a sill height of not less than 1.7 1.5 metres above finished floor
                level; and or
           b. windows and doors use translucent glazing to obscure views fixed translucent
glazing be applied to any part of the window below 1.5m above floor level; or
