3 GENERAL COMMITTEE MEETING REPORT – 15 FEBRUARY 2021

1 MCU20/0103 - DEVELOPMENT APPLICATION FOR MATERIAL CHANGE OF USE FOR
SHOP AND SHORT TERM ACCOMMODATION AT 13 NOOSA DRIVE, NOOSA HEADS
In accordance with Chapter 5B of the Local Government Act 2009, Cr Wegener provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Wegener, inform the meeting that I have a declarable conflict of interest in this matter as I have a
long standing commercial arrangement with Noosa Longboards, a surf shop located in the Hastings
Street precinct whereby I receive income from royalties for the sale of my surfboards. The tenant in the
application before Council is a commercial competitor of Noosa Longboards and operates in the same
precinct as this proposed development. As a result of my conflict of interest I will now leave the meeting
room while the matter is considered and voted on.

    Motion
    Moved: Cr Wegener
    Seconded: Cr Finzel
That Council note the report by the Coordinator Planning to the Planning & Environment
Committee Meeting dated 9 February 2021 regarding Application No. MCU20/0115 for a
Development Permit for Material Change of Use - Short-term accommodation situated at 3
Robert St, Noosaville and refuse the application for the following reasons:
    1. The proposed development is contrary to Overall Outcomes 2(a), (h) & (j) and
Performance Outcome PO6(d) of the Medium Density Residential Zone Code as
          (a) a significant number of properties in the area are already being used for visitor
accommodation and the proposal will result in the loss of a dwelling unit for use by
                 permanent residents.
          (b) the proposal has the potential to adversely impact on the residential amenity of the
                 area.
