GENERAL COMMITTEE MEETING AGENDA 16 JANUARY 2023 AO16.1 With the exception of the reuse or renovation of an existing building which does not comply, in areas other than the Coastal Communities and Noosa Heads local plan areas: a) the main roof of buildings has a pitch no less than 5 degrees; and b) eaves apply to at least 75% of the perimeter of the roof. AO16.2 The total width of any parapet wall does not exceed 50% of the width of the front facade of a building. AO16.3 Development does not include rooftop terraces. Coastal Communities Local Plan Code: AO7.2 Buildings and structures do not include rooftop terraces. PO7 Buildings, structures and landscaping are consistent with and reflect the beachside character of the local plan area in terms of form, composition and use of materials. Whilst the proposed roof top terrace remains within the 8 metre building height limit it is partially situated within the front setback, being 3.5 metres from the front boundary. Whilst front setback variations are common on the eastern side of Seaview Terrace these variations are generally limited to the ground floor level and associated with the practical limitations of providing vehicular access on a sloping site. Intrusion of the upper level into the front setback is not consistent with the character of the area and will present excessive bulk to the street and neighbouring properties and is not in accordance with PO16 and Overall Outcome (c) as detailed above. The proposed rooftop terrace will also interrupt the view line for dwellings opposite, 69 and 67 Seaview Terrace. The amended plans lodged result in a three-storey development contrary to AO7.1 of the Low Density Residential Zone Code, the third storey is 29.8m2 in area. The third story, being partially located within the front setback, is contrary to the corresponding Performance Outcome as it will visually dominate the street and surrounding area. The removal of the rooftop terrace results in a development which is low scale and more consistent with development on the eastern side of Seaview Terrace. The following images detail the footprint of the rooftop terrace and elevations of the proposal. Page 24 of 122
