GENERAL COMMITTEE MEETING AGENDA 16 JANUARY 2023 EXECUTIVE SUMMARY A report for this application was presented to Council at the General Committee Meeting dated 24 October 2022 regarding change representations made to the original development approval for a Material Change of Use for Short Term Accommodation at 401 Sunrise Road, Tinbeerwah. The applicant has made change representations to the following conditions of the decision notice: 5. The total number of guests accommodated at any one time must not exceed eight (8). 6. All outdoor areas, including balconies, decks, pools and the like, must not be used after 9pm each night. 12. The driveway, including the crossover from Sunrise Road, must be sealed to the reasonable satisfaction of the Manager Development Assessment. 15. The development must be provided with a potable water supply connected to each cabin. The storage capacity of the potable water supply must be a minimum of 5000 litres per guest. The storage capacity of the potable water supply must be a minimum of 4000 litres per guest bedroom/unit/cabin. Councillors raised several issues regarding the proposed change representations at the General Committee meeting including the maximum number of guests accommodated at any one time and carparking available onsite for guests. Further information regarding these issues was sought by Councillors and the matter was deferred to the Ordinary Meeting dated 27 October 2022. The applicant extended the decision period on 26 October 2022 to allow further discussion between planning staff and the applicant regarding the sealing of the shared access driveway (condition 12). A further site visit confirmed that the current crossover and a portion of the shared access driveway (including the access points to 393 & 403 Sunrise Road) is unsealed. The remainder of the shared access driveway towards 399 & 401 Sunrise Road is sealed and does not need to be altered. The applicant’s representation to amend condition 12 to only require sealing of the crossover is not supported due to the impacts of the unsealed section on surrounding residents. The condition is recommended to be amended to include sealing 34 metres of the shared access driveway (including the crossover from Sunrise Road) to meet up with the existing sealed portion of the driveway. In terms of carparking available to guests on the subject site, this was not raised in the applicant’s representations, however it is noted that the subject site includes an existing two car garage and sufficient carparking is available in front of the dwelling house and on the driveway for an additional 4 cars. The request to amend condition 6 is not supported due to the proximity of outdoor areas to neighbouring properties and the potential impacts from late night time use. It is recommended that conditions 5 and 15 be amended generally as requested by the applicant and the request to amend conditions 6 and 12 be refused, with condition 12 instead recommended to be amended to include the sealing of the crossover from Sunrise Road and the existing unsealed portion of the shared access driveway. RECOMMENDATION That Council note the report by the Graduate Development Planner to the General Committee Meeting dated 16 January 2023 regarding representations to Development Approval (MCU22/0067) for a Material Change of Use – Short-term accommodation situated at 401 Sunrise Road Tinbeerwah and: A. Amend conditions 5, 12 and 15 to read as follows: 5. The total number of guests accommodated at any one time must not exceed ten (10). 12. The driveway, including the crossover from Sunrise Road, must be sealed for a length of 34 metres to meet the existing sealed portion of the driveway, to the satisfaction of the Manager Development Assessment.
