PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 NOVEMBER 2022
Locality Provisions
The subject site is located in the Pomona Locality and is zoned Local Centre. The proposed use
is identified as a consistent use with the zone and is required to follow a code assessable
application process.
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below.
Heritage Overlay
The site is mapped as being contained in a Character Area under the Heritage and Character Area
Overlay Map and a review of Council records indicates that there is no building approval for the
centre building and associated shade structure which has an area of 48.6m2. The building has
been assessed against the Heritage Overlay Code and does not impact on the character of the
area or streetscape and is compatible with the area.
Car parking
The proposal involves seeking a retrospective approval to formalise the use of areas (beyond the
main building) within the site that are currently being used for food and drink outlet purposes.
Car parking requirements for a Food and drink outlet under The Noosa Plan 2020 are calculated
based on use area, excluding kitchen and food storage areas.
The proposed development will involve the following areas
• Kitchen/Bar Area: 14.45m2
• Dry Store: 2.79m2
• Outdoor Dining Area 2: 40.5m2
• Outdoor Dining Area 3: 21.0m2
• Outdoor Dining Area 4: 24.3m2
The total use area (excluding kitchen and storage areas) for the new areas is 85.8m2. The Noosa
Plan details the car parking rate for a Food and drink outlet as 1 space per 20m2 of use area and
therefore a total of 4 car parking spaces is applicable to the proposal. There is currently no onsite
carparking and it is unfeasible to provide additional carparking on the site due to the existing built
form.
The existing building at the front of the site was previously utilised for a shop and has an area of
130m2 which equates to 7 carparking spaces. The building has been renovated with kitchen and
storage areas of 42m2 installed which reduces carparking demand of this building by 2 spaces.
The proposed new outdoor dining areas are therefore 2 carparking spaces short.
It is considered that the development can operate without the provision of onsite carparking, as
evidenced by the adequate provision of alternative car parking within the township and the
business’s ability to maintain customers over the years despite not providing any onsite carparking.
It is likely that many of the customers of the business would be multi-trip customers accessing the
other shops and services that exist within the township of Pomona. In support of the proposal the
applicant also submits:
• the proposal only seeks to formalise the use of areas within the site that have historically
been used for food and drink outlet purposes. In this regard, it does not involve any expansion
of use areas or intensification of the use;
• there is sufficient on-street parking opportunities within the township of Pomona to cater for
the main street businesses, of which are unable to accommodate off-street parking.
• the existing on street parking opportunities along Memorial Avenue and Station Street
adequately meet the needs of the use and can be utilised in a safe and effective manner.
