Development Assessment Report

Project Urban – 15228 June 2016
7.2.1 OVERLAY CODES:
Biodiversity Overlay Code:
Comment: The site is identified as containing environmental protection area and riparian buffer area by the
biodiversity overlay. The proposed development has been assessed against the relevant sections of the
Biodiversity Overlay Code and the key conclusions are summarised below:
The proposed development layout has been sensitively designed to retain all vegetation mapped as being
environmentally important and to avoid new lot boundaries traversing environmentally important
vegetation. Vegetation mapped as environmental protection and riparian buffer will retained within
proposed lot 9. Retaining the abovementioned vegetation in its present form will:
Ensure the ongoing protection of the natural resources and the biological diversity of the site and
the wider locality;
Ensure new lots don’t result in the fragmentation of existing vegetation mapped as being
environmentally important;
Ensure the development is located in areas of low ecological value over areas mapped as having
higher ecological importance;
Ensure the biodiversity and ecosystem values of the Noosa River are protected by avoiding new
development in the riparian buffer area;
Ensure the scenic amenity and vegetated character of the locality and its watercourses is
reasonably retained; and
Ensure vegetation on parts of the site with the steepest slopes bordering the Noosa River is
retained to avoid erosion and landslide therefore protecting the natural resources and values of the
waterway.
In consideration for the above it is concluded that the proposed development is sympathetic to the
biodiversity values of the site and therefore complies with the relevant requirements of the Biodiversity
Overlay Code.
Natural Hazards Overlay Code:
Comment: The site is identified as containing flood hazard area, medium bushfire hazard area, and low and
high potential acid sulfate areas by the natural hazard overlay. Although being mapped within an acid
sulfate soil hazard area the proposed development is not assessable against acid sulfate soil requirements
3
of the overlay code as the proposal will not involve excavation of 100m or more of material at or below
5m AHD. The proposed development has been assessed against the relevant sections of the Natural
Hazards Overlay Code and the key conclusions are summarised below:
A very small portion of the site’s north eastern corner is identified as being subject to flood hazard. This
area of the site is located within proposed lot 9 which will accommodate the existing detached house which
is outside the identified flood hazard area. No new development is proposed within the area of the site
mapped as being subject to flood hazard. In this regard the development is considered to have avoided
potential risks to people and property associated within flooding.
A Bushfire Hazard Assessment & Management Plan prepared by North Coast Environmental is attached.
The report has been prepared to assess and reduce the degree of potential bushfire hazard on the site and
proposed development. The report includes numerous bushfire reduction measures to assist in the
protection of people and property during a bushfire emergency. The report finds that overall the proposed
reconfiguration, in combination with recommendations referenced herein, is deemed suitable for the site
with respect to providing a reasonable level of protection for people and property on the site and that the
development is considered compliant with the Bushfire Hazard provisions of the Overlay Code.
In consideration for the above it is concluded that the proposed development has responded appropriately
to the natural hazards affecting the site and therefore complies with the relevant requirements of the
Natural Hazards Overlay Code.
