Dear Mark

RE: REQUEST TO CHANGE DEVELOPMENT APPROVAL - SECTION 369 OF SPA
178 EUMUNDI NOOSA ROAD, NOOSAVILLE (LOT 101 ON SP241371, FORMALLY
        LOT 80 ON SP211687)

We act for Bunnings Properties Pty Ltd regarding an existing development approval (NC Ref:
REC12/0014) for the above mentioned site. The approval is a:

 Development Permit for Reconfiguring a Lot (1 into 2 and Park)

The development approval was originally issued by Council on 16 March 2012, and extended as
set out in the ‘Compiled Decision Notice’ dated 17 March 2014.

Under Section 369 of the Sustainable Planning Act (SPA), we write to Noosa Council, as the
responsible entity, to make a permissible change to this development approval. We provide
details below.

1. Proposal:
CHANGE TO CONDITION 9:

Under the ROL Approval Condition 9, regarding Earthworks states:

      “Earthworks
Certification of the earthworks undertaken on the lots provided by a RPEQ must be submitted
to Council prior to the sealing of the survey plan. The certification must include:
           (a) Certification that the works have been undertaken in accordance with the provisions
of AS 3798 ‘Guidelines on Earthworks for Commercial and Residential
                Development’
           (b) Test results as required by AS 3798,
           (c) Certification of the quality and uniformity of the materials.”

Certification for earthworks has been provided to Council for the earthworks undertaken over
proposed lot 101 (the Bunnings Warehouse site) and the new road. RPEQ certification has not
been provided for earthworks on proposed lot 102. We understand that Council’s interpretation of
the condition is that, certification is still required.
