site details
Background
The application originally submitted was for a secondary dwelling, but during the information request period, the application was changed by the applicant to the current proposal for short term accommodation.
Site Description
The site is undulating land in the shape of ‘U’. The existing dwelling is situated at the north eastern corner of the site. The site has direct views to Mt Cooroy and includes a tributary of the 6 Mile Creek, which feeds into Lake Macdonald on the western portion of the property. The land is sparsely treed with vegetation concentrated along the waterway and near the existing dwelling. A dwelling and horse stables are located on the eastern side of the property.
Surrounding Land Uses
The site is approximately 1km to the west of Mount Cooroy and 1.5km to the north of the Eumundi Range Lookout.
North: 244 Cooroy Mountain Rd (19ha rural zone) – detached house, sheds and dams
West: 11 Martins Rd (4.4ha rural zone) – detached house, sheds and dams
South: 43 & 49 Martins Rd (1.4 & 0.8ha rural zoned lots) – detached house, sheds and dams
East: 77 Martins Rd (32ha rural zone) – detached house, sheds and dams
assessment
Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
Noosa Plan 2020.
Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
Rural Zone Code;
Visitor Accommodation Use Code;
All Works Codes;
Biodiversity, Waterways and Wetlands Overlay Code
Bushfire Overlay Code
Landslide Hazard Overlay Code
The subject site is located in Cooroy and is zoned Rural. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below:
Criteria	Planning Scheme	Proposal	Complies
Building height storeys metres	2 storeys 8 storeys	1 storey < 8 metres
Site cover	45% max	< 10%
Gross floor area	500 m² for individual buildings	169m2 collectively for all cabins, plus dwelling 300m2

Visitor Accommodation Code
The planning scheme seeks to protect the amenity of surrounding areas from the impacts of short term accommodation. It is acknowledged that the use of premises for short term accommodation has the potential to have an impact on the amenity of the surrounding area. These impacts are often attributed to noise, vehicle movements and waste disposal. The requirement for a development application for short term accommodation provides the opportunity to regulate the use of the site so as to mitigate these potential impacts.
The following is noted in this respect:
One dwelling, is located approximately 65-75 metres from 2 cabins which are located near the access driveway, and 95 & 325m from the 2 other cabins. Two other dwellings on nearby property are in excess of 150m away from the nearest cabins;
One of the 4 cabins is proposed to have a pool. This cabin is located on the north eastern area of the site, with the nearest neighbouring dwelling 260m away. Despite the separation from surrounding properties, it is noted that noise from outdoor areas can travel a significant distance in a rural area. It is important that the use of outdoor areas is managed to mitigate amenity issues. Whilst a 9pm limit has been placed on properties within residential zoned land the later timeframe can be considered as it is reflective of the significant separation of the subject site from surrounding premises.
Sufficient area is available on site to accommodate car parking and waste storage areas.
Accordingly, conditions are recommended to address potential amenity impacts which include limiting the number of guests in total to 8 persons at any one time, prohibiting the use of outdoor areas after 10pm and requiring a register of complaints to be maintained.
The proposed use aligns with the intent of the Noosa Plan to facilitate short term accommodation within the rural area whilst maintaining the viability of rural activities on the site or the surrounding area.

A new Local Law for Short Stay letting commenced 1 February 2022 which regulates the ongoing operation of short stay letting and home hosted accommodation and manages the impacts on permanent residents and guest safety. Accordingly, an advisory note will be included on the approval to alert the applicant to the requirements under this legislation.

Biodiversity, Waterways and Wetlands Overlay
The purpose and outcomes of the Biodiversity, Waterways and Wetlands overlay code is to protect, rehabilitate and enhance ecologically important areas and improve connectivity. Small vegetated portions of the development site (western, south-western and eastern sides) are covered by the Biodiversity Overlay. A mapped waterway and riparian buffer runs the length of the western boundary (tributary of the 6 Mile Creek) with a small portion of a riparian buffer entering the site on the north-eastern/eastern boundary. The development is not sited within the Biodiversity Overlay and is located on the opposite side to the Riparian Buffer and Waterway on the western side, with no encroachment into the Riparian Buffer on the eastern side. Therefore, no disturbance within Biodiversity or Riparian mapped areas is proposed, with cabins situated in existing cleared areas, with no vegetation to be removed.

Lake MacDonald Water Catchment
The site is located in the Lake MacDonald Water Catchment area as identified by the Regional Infrastructure overlay map. The corresponding code seeks that development does not compromise water supply environmental values and cause adverse effects on the quality and quantity of water entering Lake Macdonald.

With regard to water quantity, each of the cabins have a water tank and a small footprint within the site. With regard to water quality, the applicant provided an updated plan (WD3.1a Rev E dated 2/12/21) identifying the location of the proposed effluent disposal areas relating to each of the cabins. Cabin 1 at the north eastern part of the property is near a riparian buffer with the effluent disposal system and overflow area situated west of the cabin and well away from the riparian buffer area. The system proposed is an AES (Advanced Enviro septic system) and it is noted that plumbing approval has been obtaining for this system in the same location as identified on the plans submitted by the applicant. Discussion with plumbing concluded that an AES system meets the water quality objectives detailed in the Regional Infrastructure Overlay Code.

For stage 2 (3 cabins), the applicant has submitted soil tests that have identified suitable areas for effluent disposal. It is recommended that a condition be included in the approval that these cabins are connected to a system such as AES (Advanced Enviro septic) as required by the water quality objectives sought by the Regional Infrastructure Code.

Koala Habitat
The development site is not mapped Koala Habitat or Priority Area therefore there are no QLD State requirements to be met.

Landscaping and Amenity
There is potential for the cabins to look into part of the open space area of neighbouring 49 Martins Road which is down slope from the cabins 2, 3 & 4, as some viewing is possible towards the roof of the neighbouring dwelling which is 65-75m away. It is noted that the cabins are orientated NNW instead of due west where the house is located. The applicant proposes to provide additional screening landscaping to be provided around the property boundary shared with No. 49 to protect amenity. Images provided demonstrated that the cabins are appropriately setback and with screening will have limited opportunity to overlook into the property. The proposed landscaping is included as conditions to ensure all levels of understoreys are included to ensure height and appropriate screening is achieved.

Bushfire
The development site is mapped with Bushfire Hazard Overlay Map – Potential Impact Buffer over the southern and western sides with a Medium Potential Bushfire Intensity mapped on the western side. The applicant’s response to a further information request received 17 December 2021 details that the buildings are not mapped by a bushfire hazard overlay or hazard buffer and there is no requirement to undertake a bushfire hazard plan under The Noosa Plan or The State Planning Policy. In the event of a fire, the owner will manage any evacuation in accordance with the relevant advice from the authorities.

The Bushfire Hazard Overlay Code outcome is to ensure that development avoids or mitigates the potential adverse impacts of bushfire on people, property, economic activity and the environment. Performance Outcome PO6 requires easy and safe evacuation of residence of premises and access by emergency services. The cabins are not located within a mapped bushfire hazard overlay but some are adjacent to a Medium Potential Bushfire Intensity area and the access/egress track is through Potential Impact Buffer. Therefore, although a Bushfire Assessment and Management Plan is not required under the Noosa Plan 2020 a condition requiring maintenance on the access track to ensure safe access and egress is available at all times to all the development for emergency vehicles and personnel to ensure compliance with Acceptable outcome AO6.4 of the Bushfire hazard overlay code.

The proposal indicates rainwater tanks are to be provided with each of the cabins in accordance with the relevant guidelines and a condition will be included to this effect. This will provide additional bushfire management resources if needed.

conclusion & reasons for decision
The application seeks to construct 4 cabins, situated within the Rural Zone, for the purpose of short term accommodation. The key issues associated with the assessment of the application are the potential for detrimental impacts on the amenity of the surrounding properties and the compatibility with surrounding rural uses. These issues have been conditioned accordingly. Further, given the site is located in the Lake Macdonald water catchment area, conditions have been included to ensure water quality is protected.
The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
