PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 APRIL 2015
Seqwater has prepared guidelines on how to address development in drinking water
catchments. These guidelines should be considered in planning and development
assessment decisions for all land from which water flows to drinking water supplies.
Noosa’s planning scheme identifies the site within the catchment to Lake Macdonald and
currently seeks to avoid expanded development within it. The development can meet the
Seqwater development guidelines but these apply to permitted development on land already
committed for development purposes. No planning study exists that invalidates The Noosa
Plan’s precautionary approach of avoiding expanded urban development in the catchment
and the development conflicts with the SEQ Regional Plan in this regard.
State Planning Regulatory Provisions
The following State Planning Regulatory Provisions apply to the application:
SEQ Regional Plan Regulatory Provisions
The proposal is for an urban activity within the Urban Footprint and is consistent with the
SEQ Regional Plan Regulatory Provisions.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Cooroy & Lake Macdonald Locality and is zoned Rural. The
proposed uses are identified as inconsistent within the zone and required to follow an impact
assessable application process.
Cooroy & Lake Macdonald Locality Code Provisions
Broad conflicts are raised with the locality code provisions for the site because the code
does not anticipate or provide for urban development in the rural zone. Caravan Parks are
consistent with the Rural zone but only outside of the water supply catchment area. As
such, all the proposed uses are listed as inconsistent and Specific Outcome O80 states that
these are not located in the Rural Zone. Relevant overall outcomes of the code include:
6.8.2 a) New uses and works are located, designed and managed to—
i be compatible with other uses and works;
ii maintain the safety of works;
iii avoid significant adverse impacts on the amenity enjoyed by users of other
premises, including acoustic and visual qualities; and
iv avoid significant adverse effects on the natural environment, including
native habitat removal, fragmentation and attrition;
b) The Cooroy and Lake Macdonald Locality supports a growing urban and rural
settlement of permanent residents;
c) Development is consistent with the Priority Infrastructure Plan in Part 15.
d) Cooroy retains its role as the major business centre for Noosa’s hinterland area;
e) The relaxed country town atmosphere of Cooroy is protected for the enjoyment of
future generations;
g) The traditional built form of Cooroy is retained and new development complements
traditional streetscape and building forms;
h) Outside the town of Cooroy, development is characterised by—
….
ii conservation of open space for biodiversity and water quality purposes;
