GENERAL COMMITTEE MEETING AGENDA 28 APRIL 2014
(i) further rights to make a submission may be available for a further development application;
and
(ii) the likely extent to which those rights may be exercised; and
(d) the views of any concurrence agency for the approval…
5. ASSESSMENT
Consistency with Current Planning Scheme
Assessment against the current planning scheme has revealed that the original application is still
generally compliant with the applicable provisions as there have been no changes to the planning
scheme since the assessment of this application.
Whilst additional pontoons are being added to the development, this is considered consistent
with the general manner in which the lease area is currently used by the operator. The lease is
one of 16 approved commercial leases on the river and the pontoons are wholly contained within
the lease area. Currently, the operator lashes together a number of boats past the existing
mooring structures, moving them adjacent to the jetty and pontoons as they are hired. The
proposed extensions will formalise this arrangement.
The pontoons design and layout is otherwise compatible with its setting and maintains the visual
amenity of the Noosa River in this location and will not unduly clutter the Noosa River.
An aerial photo of the site (August 2013) is included as Attachment 3 and a photo of the site of
the proposed works is included as Attachment 4.
Community’s Current Awareness of the Development, Rights to Submit and Likelihood of
Further Submissions
The application was code assessable and was not publically notified. These criteria are therefore
not relevant to the assessment of the application.
Concurrence Agencies
The Department of State Development, Infrastructure and Planning, acting as a concurrence
agency for the relevant departments, have advised that “it has no objection to the extension
being approved”.
Changes to current approval
In agreeing to the request to extend the relevant period it will be necessary to change Condition
18 to refer to the new date and read as follows:
“The Development Permit for Operational Works lapses if the works have not been completed by
31 January 2016, unless an application to extend the currency is approved by Council.”
6. CONCLUSION
The application is consistent with the relevant provisions of the Sustainable Planning Act 2009
and the Noosa Plan and does not raise any concerns.
