Originally, the lease was classified as a commercial lease however the annual rental of $500p/a
is more in line with that of a community lease. Additionally, a community lease classification is
more appropriate given the community service provided by DHPW. DHPW will still be required to
gain their Minister’s exemption to the new lease.
Under Section 236(1)(b)(i) of the Local Government Regulation 2012, Council is not required to
tender for the leasing of the property as the purpose of renewal of the lease is to a government
agency. The requirements for this exception are that a relevant Council Resolution is first
obtained.
