Dear Marcus

                         REQUEST FOR PROPERTY BRANCH VIEWS
PROPOSED EASEMENT OVER COUNCIL OWNED LAND AT
                           22 RIFLE ST POMONA - LOT 1 RP35098

I refer to your letter email dated 27 February seeking written agreement to establish an easement over Council
freehold land at 22 Rifle Street Pomona to accommodate new drainage infrastructure proposed as part of your
client’s unit development (development applications MCU24/0165 and OPW24/0222).

Council’s freehold parcel at 22 Rifle Street site is vacant land and mostly vegetated. In considering the
proposed easement, the Property team has consulted with site’s Asset Manager, the Open Space unit within
Council’s Environment Branch.

I can advise there is in-principle support to establish the easement, subject to the full assessment of the
development applications. It is important to note:
 At this stage, only in-principle support can be provided, as this advice cannot pre-empt the Assessment
Manager’s assessment of the development applications and the proposed works, including environmental
and cultural heritage considerations related to the works.
 The establishment of an easement must follow the processes outlined in the Land Title Act 1994 (Qld),
which may include compensation to Council as the owner of the burdened parcel.
Council’s consent to proceed with an easement will hinge on the outcome of these processes.

I trust this advice is of assistance. Please feel free to contact me if you have further queries.

Yours sincerely

DW
