1.0 Biodiversity, Waterways and Wetlands Overlay Code
(1) The purpose of the Biodiversity, Waterways and Wetlands overlay code is to protect, rehabilitate and enhance ecologically important areas and improve
connectivity and ecological linkages across Noosa Shire.
(2) The overall outcomes sought for the Biodiversity, Waterways and Wetlands overlay code are:
(a) The natural resources and ecosystem values of Noosa Shire are protected and enhanced including ecologically important areas and land and
environmental values of scenic, aesthetic, cultural, educational, recreational, scientific, economic and social value.
(b) Development is designed, sited, constructed and operated in a way that avoids adverse impacts on ecologically important areas, ecological systems and
processes.
(c) Development design and layout provides for ecological connectivity across the landscape through the protection, rehabilitation and enhancement of
native vegetation and ecological linkages.
(d) Ecological linkages and riparian vegetation are conserved, managed, enhanced and rehabilitated to protect and improve biodiversity, ecosystem health,
landscape stability and resilience.
(e) Development design and layout provides for the protection and establishment of appropriate buffers to waterways, wetlands, native vegetation and
significant fauna habitat.
(f) The terrestrial and aquatic native flora and fauna and their habitats are protected and enhanced.
(g) Development and its associated landscaping provides for the rehabilitation of ecologically important areas, degraded ecosystems and habitats to achieve
a functional and healthy ecosystem state that requires minimal human intervention.
(h) Development is designed, sited, constructed and operated to avoid or minimise adverse impacts on koalas and their habitat and to provide for
connectivity and safety for the long term viability of the koala population.
(i) In urban areas, biodiversity values are protected and enhanced to assist with ecosystem health, flora and fauna, urban amenity and quality of life.
Table One assesses the overall outcomes that are relevant to this development. The solutions provided to the overall outcomes demonstrate the proposal is generally in
accordance with the Biodiversity, Waterways and Wetlands Overlay Code.

2.0 Rural Zone Code
1. The purpose of the Rural zone is to:
(a) provide for rural uses and activities; and
(b) provide for other uses and activities that are compatible with:
i. existing and future rural uses and activities; and
ii. the character and environmental features of the zone; and
(c) maintain the capacity of land for rural uses and activities by protecting and managing significant natural resources and processes.
2. The overall outcomes sought for the Rural zone are as follows:-
(a) The establishment of a wide range of rural activities is facilitated, including animal husbandry, aquaculture, cropping, horticulture, roadside stalls, rural
industries, forest practices, wholesale nurseries and other primary production and compatible uses.
(b) The viability of existing and future rural activities is protected from the intrusion of incompatible uses.
(c) Areas for primary production are conserved and lot fragmentation is avoided.
(d) Existing extractive industries and key resource areas are protected from the intrusion of incompatible uses.
(e) Rural activities embrace sustainable land management practices and contribute to the amenity and landscape of the area. Livestock enterprises are
predominantly pasture fed, free range operations.
(f) More intensive rural activities including animal keeping, intensive horticulture and extractive industry may be established in the zone provided that adverse
environmental and amenity impacts including the generation of noise, dust or odour are avoided with sensitive land uses buffered from impacts.
(g) Lot reconfigurations are typically limited to instances of protecting remnant vegetation or riparian corridors or improving the delivery or function of regional
infrastructure.
(h) The establishment of outdoor recreation and small-scale tourism facilities in suitable locations is facilitated in a manner that does not significantly compromise
the rural productivity or ecological values of the land.
(i) Visitor accommodation complements rural uses and promotes the sustainable use of rural land.
(j) Houses or outbuildings may be available for short term guests where there is no resultant changes to the rural amenity or rural production of the area.
(k) Nature based tourism adopts exemplary standards of ecologically sustainable design and facilitates appreciation of the natural environment.
(l) Rural activities provide for appropriate value adding to produce on site where adverse environmental and amenity impacts are avoided.
(m) Home-based businesses which add to the economic sustainability of the hinterland are established where the nature, scale and intensity of the activity is
compatible with the character and amenity of the surrounding locality.
(n) Development is reflective of, and sensitively responds to, the environmental constraints of the land.
(o) Natural features such as creeks, gullies, waterways, wetlands and vegetated hillslopes and ridgelines are retained, managed and enhanced where possible.
(p) Development maintains and enhances the significant scenic and landscape values of the area. The built form of development integrates with and complements
the rural character intended for the zone and sensitively responds to the landscape.
(q) Development does not reduce the vegetated open space and rural landscapes that frame distinct towns and villages.
(r) Development protects and provides for recreational trails.

3.0 Low Density Housing Code
1. The purpose of the Low density housing code is to ensure dwelling houses, community residences, rooming accommodation and short term
accommodation (where no more than one detached dwelling on the site) :
(a) are appropriately located;
(b) achieve a high level of comfort and amenity for occupants;
(c) maintain amenity and privacy of neighbouring residential premises; and
(d) are compatible with the character and streetscape of the local area.
2. The overall outcomes sought for the Low density residential code are:
(a) Development incorporates a high standard of design and makes a positive contribution to the streetscape character of the area in which it is located.
(b) Development is sited and designed to protect the amenity and privacy of neighbouring premises.
(c) Development provides a high level of safety, security and amenity for residents.
(d) Development is provided with an acceptable level of infrastructure and services.
(e) Where not in a sewerage service area, effluent disposal systems are designed and sited to avoid adverse effects on the environment.

(f) Driveways and crossovers provide safe and reasonable vehicle access from the carriageway to the property boundary, minimise adverse effects
on Council’s infrastructure and ensure safety for all users of the footpath.
(g) Community residences in the Low density residential zone are of a domestic scale with traffic levels which do not unreasonably affect the residential
amenity of neighbours.
(h) Secondary dwellings are small scale, subordinate to the dwelling and provide housing choice and amenity for the occupants.
(i) Rooming accommodation in the Low density residential zone is of domestic scale and provides housing choice to meet the varying needs of the
community.
(j) Buildings relocated from other sites do not pose a health or safety risk or adversely affect the amenity of their neighbourhood or existing infrastructure.
(k) Development maintains the natural landscape character and visual quality of hillslopes and ridgelines and avoids adverse impacts on the environmental
values of the land.
Table Three assesses the overall outcomes that are relevant to this development. The solutions provided to the overall outcomes demonstrate the proposal is generally in
accordance with the Low Density Housing Code.
