1. SITE 1.14. PROPERTY DETAILS: - Description: Lots 11 and 12 on RP43995 — a copy of a Smartmap is attached as Appendix A showing the location of the properties. Noosa Plan 2020 Zone: Low Density Residential Overlay: Heritage & Character Area — Character Area SE Queensland Regional Plan: Urban Footprint. 1.2 SITE DESCRIPTION 4Xr4asyyD Aerial photo of site: Source NSC The subject property comprises 2 Lots located at the north-western intersection of Rectory and Red Streets at Pomona. The property contains a total area of 1,670m?.
Page 3
A dwelling house stands over the common boundary between Lots 11 & 12 and is located towards the Red Street frontage, and a garage stands adjacent to the western boundary. The properties are generally undulating with a slope of approximately 8% down to the Red Street frontage. Power, telecommunication, water and sewerage services are connected and available to the properties. Both Rectory Street and Red Street are good quality bitumen roads. A driveway provides ingress/egress to Rectory Street from the dwelling and the garage. The adjacent properties have an area of approximately 840m?. 2. PROPOSAL It is intended to realign the common boundaries of the Lots to create two Lots fronting Rectory Street as shown on the Plan of Proposed Reconfiguration (Ref: 04- 1730AC contained in Appendix B). The proposed new lot layout will create Lots with a longer east-west orientation and create Lots with access to the streets without removal of any vegetation. The development will also require the existing house to be re-located on the new Lot 12. There is sufficient area to re-locate the dwelling on the new Lot with setbacks that comply with the Building Codes and the provisions of the Noosa Planning Scheme. The new Lot 11 will contain 804m? and the new Lot 12 will contain 866m? and comprise the re-located house. The realignment has no impact upon the adjoining properties or upon the existing services. The Reconfiguration will require a water meter for Lot 11 and a new house connection to the sewer reticulation. 3. STATUTORY ASSESSMENT — STATE GOVERNMENT 3.1 State Planning Regulatory Provisions The site is included within the SEQ Regional Plan State Planning Regulatory Provisions — Urban Footprint; no additional Lots are created therefore no further assessment is required.
Page 4
3.2 Referral and State Development Assessment Provisions It is considered that the application will require referral to SARA as a concurrence agency. 3.3 State Planning Policies The site is not mapped as being affected by any of the State Planning Policy’s State interest 4. NOOSA PLAN 2020 The subject lands are located in the Low Density Residential Zone. The subject lands are affected by the following Overlay of the Planning Scheme: e Heritage & Character Area: Character Area The above overlay does not affect the level of assessment of the application. The proposal has been assessed against the relevant codes including: The Lot Reconfiguration Code, the Rural Zone Code, the relevant overlay code and the relevant development codes. The aspect of the codes that does not comply with the Acceptable Solutions is discussed below. 4.1 Reconfiguring a Lot Code Performance Outcome PO5 The proposed Lots do not comply with the preferred minimum lot size of 1,000m? as specified in Table 9.5.1.4. of the code. Notwithstanding the above it is considered that the proposal can satisfy the relevant requirement of Performance Outcome POS for the following reasons: ¢ The proposed lots are appropriate with the intended use and the character of the local area. e The proposed Lots eliminate the encroachment of the house. ¢ The proposed lot areas comply with the minimum prescribed area prescribed in the relevant Planning Scheme at the time they were originally created. e The new boundaries have been located to create 2 Lots with increased solar access.
Page 5
e The size and the shape of the proposed Lots are sufficient to accommodate a dwelling houses and services and are consistent with the character of the local area. ¢ There is no impact upon the provision of services or access to the Lots. 4.2 Overlay Code Specific Outcomes and Probable Solutions of Heritage Overlay Code The proposal retains the existing house by re-positioning it within the new Lot 12 closer to the street frontages. The character of any new dwelling on the proposed Lot 11 can be addressed as a part of a Building Application. The proposal has no impact historic architectural features of the local area or the grid pattern of the streets. The proposal complies with the Overall Outcomes of the Heritage Overlay Code. 5. CONCLUSIONS The planning assessment has been prepared to accompany a code assessable application for a Development Permit for Reconfiguration of Lots 11 and 12 on RP43995 to realign the common boundary. The assessment concludes that the proposal complies with, or with the imposition of relevant conditions, the relevant provisions of the applicable codes in the Noosa Plan 2020; therefore, it is recommended that the application should be approved subject to reasonable and relevant conditions of approval. | look forward to Council processing the application. Do not hesitate to contact this Office if you have any queries. Yours faithfully Mh Max Watterson
