With regard to carparking calculations, the toilet areas have not been included in the calculations as
these are considered to be publically available for all uses on the site when the site is operating. This
approach is consistent with Councils approach to assessment for commercial uses and confirmed by
recent Council approvals where toilets were considered ‘back of house’ and not assessed for
carparking including:
• MCU16/0082 – Restaurant and Micro Brewery at 1/50-52 Kauri Street, Cooroy (disabled toilet
approved as ‘back of house’)
• MCU15/0086 - Restaurant – 2 Bottlebrush Avenue Noosa Heads – (toilets to the rear of site
only service shops and patrons)
Item 3: To address the removal of the underground petrol tanks and the shortfall of car parking it is
requested that a meeting be held to discuss these matters being addressed by an Infrastructure
Agreement.
Applicant’s Response to Item 3: The applicant does not own the site and has no control of the tanks
or previous use of the soitenotes that the underground tanks are not located on the subject site. The
proposed use does not trigger assessment under Part 4 Contaminated Land of the Planning
Regulation 2017 and no changes are proposes to the footpath area in front of the site.
The applicant considers that he has now responded to Council’s information request. The Decision
Making Period has therefore commenced and we request that your Council proceeds with its
assessment of the application as soon as possible in accordance with the Planning Act 2016.
