Dear Madam
Information Request
Planning Act 2016
I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.
application details
Application No.	OPW21/0332
Street Address:	26 Sallwood Ct Pinbarren Qld 4568
Real Property Description:	Lot 3 SP 170088
Planning Scheme:	Noosa Plan 2020 (25 September 2020)
INFORMATION REQUIRED
The information requested is set out below:
Issue
The works included earthworks across the site and in the existing overland flowpath. It is also noted that parts of the site where the works occurred are mapped in The Noosa Plan 2020 as being within the Landslide Hazard Overlay. The submitted material does not include a plan indicating the extent and type of earthworks.
Information Required
Provide a plan indicating the extent and type of earthworks. The plan must be prepared by a suitably qualified person (Registered Professional Engineer of Queensland) and include by not be limited to:
The extent of earthworks within the site including the works undertaken on the dam
The works undertaken in the overland flowpath and any future protection works
Comment regarding the ongoing stability of that part of the site located within the Landslide Hazard Overlay that may have been impacted by the works
Existing and future erosion and sediment control works

Issue
No detail has been provided of what vegetation is proposed to be cleared, the extent of clearing and the locations of clearing.
Note. Bulk clearing of Camphor laurel may create waterway bank instability and remove fauna habitat – consultation with a suitably qualified person will provide an appropriate weed management and rehabilitation strategy.
Information Request
Provide a detailed map of the locations, species and extent of clearing that has been completed.
Provide a detailed map of clearing that is proposed to be completed.
Detail the species names and numbers that are proposed to be removed.

Issue
Erosion is a potential risk when completing vegetation removal and rehabilitation activities. It is understood that an Erosion and Sediment Report has been supplied for the works that have been completed prior to this application. With ongoing works an Erosion and Sediment Control Plan is required.
Information Request
Provide an Erosion and Sediment Control Plan completed by a suitably qualified person detailing erosion and sediment control methods required for the proposed works.

Issue
A mapped waterway runs through the centre of the site. The Noosa Plan 2020 includes this mapped waterway within the Biodiversity, Waterways and Wetlands Overlay Code. Assessment of the proposed works against the Noosa Plan 2020 - Biodiversity, Waterways and Wetlands Overlay Code is required.
Information Request
Provide a table outlining how the proposed works meet each of the Performance Outcomes or Acceptable Outcomes (whichever is more appropriate) for the Biodiversity, Waterways and Wetlands Overlay Code.

Issue
Rehabilitation of the waterway is a requirement within the Noosa Plan 2020 Biodiversity, Waterways and Wetlands Overlay Code. Performance Outcome PO1 requires ecological important areas (e.g. mapped waterways) are protected and enhanced. Performance Outcome PO6 further details that ‘the biodiversity and ecosystem values of waterways, wetlands and adjacent riparian zones are protected’. With Acceptable Outcome AO6.2 requiring ‘development provides for the rehabilitation of land within:
a riparian buffer area;
a wetland area; and
10 metres either side of the centre line of any other waterway identified on a Biodiversity, Waterways and Wetlands Overlay Map’.
Information Request
Provide an Ecological Assessment and Rehabilitation Plan completed by a suitably qualified person outlining:
Weed management required and management techniques and timeframes (ensuring bank stability and fauna habitat is considered);
Rehabilitation 10m either side of the centre line of the Biodiversity, Waterway and Wetlands Overlay mapped waterway;
Include details regarding fauna management activities required e.g. fauna spotter and catcher.

Issue
The ‘Garden Plan’ provided includes ‘sub-tropical garden, lawn and kids playground garden’ within the vicinity of the mapped waterway however these are likely to not be the natural state of the waterway. Rehabilitation 10m either side of the centre line of any mapped waterways is a requirement and needs to return the waterway to its natural state.
Information Request
Provide a detailed rehabilitation plan (prepared by a suitably qualified person) for the required 10m either side of the centre line of the mapped waterway to return the waterway to its natural state.
Provide within the Rehabilitation Plan an assortment of groundcover, lower, mid and upper-story Australian Natives suitable for the area ensuring the following details are included:
Species names;
Numbers of each species;
Planting density; and
Species planting locations.
Note. Suitably Qualified Person, for the purpose of:
Supervising landscape works and preparing a landscape certification, is considered to be a landscape architect, landscape designer or horticulturist with a minimum of three years current experience in the field of landscape design.
Undertaking rehabilitation construction and establishment works is considered to be a person with five years current experience in revegetation and regeneration.
Undertaking, supervising tree works and preparing arboriculture certification, is considered to be a person with a minimum three years current experience in tree protection, hazard identification/mitigation and Specifying Trees – a guide to assessment of tree quality (NATSPEC) assessment and either:
International Society of Arboriculture (ISA) certification; or
A Diploma of Arboriculture.
Managing Fauna protection is considered to be a certified Fauna Spotter Catcher.
