EXECUTIVE SUMMARY
The procurement of Council’s goods and services must be carried out in accordance with the
Local Government Act 2009 and the default contracting procedures outlined in the Local
Government Regulation 2012. The Local Government Regulation 2012 also allows for
exceptions to the default contracting procedures, including the approval of a supplier being
deemed as sole or specialised.

RECOMMENDATION
That Council note the report by the Procurement & Contracts Advisor to the Services &
Organisation Committee Meeting dated 11 October 2022 and
A. Adopt the amended Sole Supplier list provided at Attachment 1 to the report for the next
      twelve (12) months; and
B. Adopt the amended Specialised Supplier list provided at Attachment 2 for the next twelve
      (12) months.

REPORT
The Local Government Regulation 2012 (“the Regulation”) provides for different methodologies
to establish medium and large sized contracts.
Medium sized contracts, defined as being of contract value greater than $15,000 and less than
$200,000 (exclusive of GST), require three (3) written quotations to be invited.
Large sized contracts defined as being of contract value greater than $200,000 (exclusive of
GST); require written tenders by public invitation.
The Regulation (Section 235) allows exceptions to these requirements under certain
circumstances, including where the suppliers are sole or specialised providers of a good or
service:
A local government may enter into a medium-sized contractual arrangement or large-sized
contractual arrangement without first inviting written quotes or tenders if—
     (a) the local government resolves it is satisfied that there is only 1 supplier who is
     reasonably available; or
     (b) the local government resolves that, because of the specialised or confidential nature of
the services that are sought, it would be impractical or disadvantageous for the local
government to invite quotes or tenders.
As such, Council reviews the sole and specialised lists annually to ensure their appropriateness
and currency and subsequently seeks Council resolution to adopt the revised/amended lists.
A resolution to adopt these updated lists will allow Council to engage with these sole and
specialised suppliers in a more timely manner than if inviting quotes or tenders.
