GENERAL COMMITTEE MEETING AGENDA 17 JUNE 2019
Therefore, the filling and vegetation clearing was undertaken in breach of the Noosa Plan and
contrary to the Planning Act 2016.
The map below depicts the area where the fill was dumped and vegetation cleared.
Council resolved at the Ordinary Meeting of 20 September 2018 to continue enforcement against
Noosa Airfield to address the current breaches of The Noosa Plan.
In accordance with the Planning & Environment Court’s directions, mediation was attended by
Council officers and Noosa Airfield with the court registrar on 23 April 2019. At the mediation the
unlawful works were discussed with Noosa Airfield and Noosa Airfield was again requested to
undertake the actions outlined in the Enforcement Notice, including removal of unclean fill
material and ecological rehabilitation of the area cleared of vegetation.
Noosa Airfield agreed at mediation to undertake the required restitution works including the
following:
Remove the concrete and fill material from locations 1, 2 and 3 within 90 days of the signed
agreement subject to necessary extension if circumstances dictate (i.e. such as the site
being inaccessible due to wet weather). Locations 1, 2 and 3 are identified in the plan
attached to the Mediation Agreement included as Attachment 1.
Provide certification by a suitably qualified person with respect to any material proposed to
be retained on site for maintenance purposes, that is, clean fill.
Submit a revegetation plan for the area to be rehabilitated for Council approval and within a
further 90 days of the Council approval undertake the works required by the revegetation
plan.
The agreement reached at mediation is set out in Attachment 1, with the area to be rehabilitated
included as Attachment 2. Notably the area to be rehabilitated was only provided on 31 May
2019 with Noosa Airfield previously seeking to maintain an area clear of vegetation for a future
car park.
