GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
It is proposed to construct a two-storey building, including two basement levels of car parking, with
a proposed gross floor area of 2,170m2. The floor area is proposed to be used interchangeably
between Commercial Business Type 1 - Office and Commercial Business Type 2 – Medical.
The development will gain access from the internal loop road within the Noosa Civic site via a
single cross over with 91 car parks provided within a basement, 8 additional car spaces and 1
ambulance space is provided at ground level.
The application generally complies with the Noosa Plan 2006 except with regards to the acceptable
solutions for front setback, building height, wall length, and landscape setback. The elements of
non-compliance are supported on the basis that the building provides a positive design contribution
to the entry of Noosa Civic and complies with the outcomes of the Noosa Plan 2006 and/or Noosa
Plan 2020.
The application is recommended for approval subject to conditions.

2. SITE DETAILS
2.1. Background
The Noosa Business Centre has partly been developed with the Noosa Civic established in
October 2006 as Stage 1. Stage 1 involved the establishment of a discount department store-
based shopping centre of approximately 18,300m2 total use area, along with 7,000m2 total use
area of retail showrooms, a service station and 5,000m2 total use area of commercial office space.
As part of the approval for Stage 1, Lot 3 SP182845 was dedicated as open space to the State.
In 2003, the applicant entered into an Infrastructure Agreement which in part provided for
infrastructure items to be provided by the applicant for the existing and future development of the
land in total. The agreement also included dedication of land as road reserve and for public open
space purposes. Furthermore, the agreement provided that there would be no requirement for
contributions to be paid (by way of conditions imposed on any application) nor pay infrastructure
charges associated with the future development of the land provided that the intensity of
development of a future stage did not exceed that envisaged by MP2.
On 20 February 2020, Council, at its Ordinary meeting resolved to refuse an application to
reconfigure 1 lot into 23 lots. As a result of Council’s decision to refuse the subdivision, the
applicant lodged an appeal to the Planning & Environment Court. During the course of the appeal
a series of without prejudice meetings were held, which resulted in a negotiated settlement on 3
September 2020 which allowed for 1 into 23 lot reconfiguration to proceed subject to conditions.
The works for this subdivision are currently under construction and expected to be fully completed
in next few months.
On 16 September 2021, Council at its Ordinary meeting resolved to agree to a request to assess
an application for Commercial Business Type 1 Office and Commercial Business Type 2 Medical

2.3. Surrounding Land Uses
The Noosaville industrial estate is adjacent the site to the west, with Rene Street extending into
the Noosa Business Centre and connecting to Hofmann Drive. The estate contains a broad mix of
industrial and business uses. Adjacent lots within the SBC to the west and south west of the site
fronting Hofmann Drive and Rene Street have been developed for warehousing, storage,
distribution, manufacturing and trade showroom uses. Lionel Donovan Drive is to the north of the
site, across Eenie Creek Road, and is predominantly developed for motor vehicle sales businesses
and complementary industrial business uses. Noosa Domain retirement village is north of the site
across Eenie Creek Road. Substantial open space and conservation lands containing remnant
vegetation are adjacent the site to the south and east and conserved in National Park or
Environmental Reserve, with Eenie Creek approximately 500m to the south flowing to Lake Weyba
1.5km to the southeast.

Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017;
• Noosa Plan 2006.
3.2. State and Other Statutory Instruments
State Planning Policy
Noosa Plan 2020 is generally consistent with the State Planning Policy July 2017 (SPP) and the
SPP raises no further issues relevant to the proposed development.
South East Queensland (SEQ) Regional Plan
The site is located within the Urban Footprint of the SEQ Regional Plan. The proposal is consistent
with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The proposal is for urban activity within the Urban Footprint and is consistent with the assessment
benchmarks contained in the Planning Regulation 2017 for the SEQ Region.
3.3. Statutory Instruments – Planning Scheme
The application must be assessed against each of the following codes to the extent they are
relevant to the development:
• Noosaville Locality Code
• Business Uses Code;
• Works Codes.
Locality Provisions
The subject site is located in the Noosaville Locality and is zoned Shire Business Centre Zone.
The proposed use is identified as a consistent use with the zone and is required to follow a code
assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below:

Height
The proposed maximum building height of 10.2 metres relates to the roof form. The red line depicts
that part of the building that is 8.0 metres in height with the yellow line identifying the 10.2 metre
height of the feature roof.
Figure 14: Building height
Whilst the maximum height is a considerable variation to the maximum allowable under the
superseded planning scheme it is noted that a significant aspect of the development remains within
the required 8.0 metres. The Noosa Plan 2020 also permits a maximum height of 12.0 metres
within 50 metres of the corner, with the remainder permitted to be 10 metres, as it is acknowledged
as a gateway site within the Noosa Business Centre and Framework Character Plan. In this regard,
the planning scheme is seeking buildings which are a signature at the identified gateways to the
Noosa Business Centre. The proposed building design, inclusive of its height, provide an
appropriate entry statement and is consistent with the intended development pattern for the site.

Front setback
The planning scheme seeks a 6.0 metre setback to the internal loop road. The following image
details where the development intrudes into the front setback. This is primarily located at the south
western corner of the site where the road and site frontage both curve. An arbour is also located
at the front boundary with a 0m setback. The 6.0metre setback is highlighted in yellow in the
following image:
Figure 14: Setback area (yellow) demonstrating extent of setback intrusion
The variations to the 6.0 metre setback are generally minor with the most significant intrusion at
the south-western corner of the site, where a setback of 5.4 metres is proposed to the building
façade and 2.9 metres to the balcony which borders the building. It is noted that maximum height
of the building is at this location. The following image identifies where the building intrudes into the
6.0 metre setback at the south-western corner of the site.
Section 23
GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
Figure 15: Setback intrusion at south-western corner
The setback variations of the building generally relate to the external veranda and architectural
treatments which skirt the building. The veranda provides amenity for users of the premises and
assists in avoiding large areas of continuous wall planes. In some regard, the non-complying
setback is a consequence of the irregular shape of the lot at the south-western corner of the site,
noting that most of the building complies or exceeds the setback requirement. Furthermore,
sufficient area is available around the building for landscaping, with the concept landscape plans
including a feature tree in the south-western corner to offset the built form in this location.
The arbour facilitates in softening the commercial development and provides for street activation,
the greenery associated with the arbour will enhance the entry statement of the development.
It is noted that the Noosa Plan 2020 has amended the setback requirements for the site with the
new scheme requiring a setback of 4 metres.
Wall length
The planning scheme seeks to limit the maximum wall length of a building to 15 metres. The Noosa
Plan 2006 defines wall length as:
wall length means the length of any external wall in one plane, provided that—
a) walls that are offset by less than 600mm are measured as one wall; and
b) walls that are on the same alignment and are separated by less than 25m are measured
as one wall.
Whilst each façade of the building exceeds a length of 15 metres on the one plane, 3 of the 4 sides
of the building are located behind a balcony and architectural treatments that obscure direct views
of the building façade. The architectural treatments are lightweight and consist of natural colours
that soften the built form and provide for a visually interesting building. Whilst the rear elevation is
the most plain of the building elevations it is primarily obscured by the 10-metre-wide vegetated
covenant that is situated adjacent the sites northern boundary. The elevation also comprises a mix
of materials whilst the western end of the elevation is stepped in from the remainder of the
elevation.
Car parking
The application proposes car parking spaces in accordance with the planning scheme minimum
number of required car parking spaces however includes 24 tandem car parking spaces, 12 on
each basement level. Whilst a small number of tandem spaces, for staff car parking, is generally
considered acceptable it is noted that the current proposal seeks to provide a significant number
of spaces in a tandem arrangement. An external traffic consultant has reviewed the proposed car
Page 23 of 122
Section 24
GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
parking layout who is supportive of their inclusion on the basis that the tandem spaces should not
be used by visitors. They should only be used by staff, and only by staff of the same tenancy, so
that use of the tandem spaces can be regularly used by drivers who know the system for their use.
The review of the car parking also noted that it is true that other local authorities have lower parking
requirements for office developments, than the 1 space per 20m2 requirement at Noosa. For
example, BCC’s, Sunshine Coast and Gold Coast have office parking requirements are all about
1 space per 30m2. Although it is also highlighted that those other local authorities all have similar
medical centre parking requirements as Noosa’s being 1 space per 20m2.
Conditions are recommended to address the use of the tandem spaces with suggested wording
as follows:
Each tandem parking space arrangement (i.e. 2 spaces) is to be allocated to a single tenant.
Signage is to be installed and maintained at all times identifying the allocation of the tandem
spaces. The use of the tandem spaces is to be by staff only.
A management plan is to be prepared documenting in detail options for how use and operation of
the tandem parking spaces is to be managed by individual tenants to ensure that both spaces of
each tandem space are effectively utilised. That management plan is prepared to the satisfaction
of Council, and prior to the commencement of use on the site is to be incorporated into the
requirements and procedures of the body corporate
Bicycle spaces
The proposal includes 8 bicycle spaces in lieu of the 44 spaces required. Whilst it is acknowledged
that other bike spaces will be throughout Noosa Civic they not readily available in proximity of the
subject site. However, the provision of 44 bicycle spaces is excessive. Discussions with the
applicant identified 16 spaces as being mutually agreeable noting that 14 spaces would be required
under the Noosa Plan 2020. Accordingly, it is recommended that a condition be included requiring
16 bicycle spaces.
No detail has been provided as to how the floor areas are to be developed therefore lockers and
shower cubicles have not been detailed on the plans. It is recommended that a condition be
included ensuring the provision of lockers and shower cubicles.

5. CONCLUSION & REASONS FOR DECISION
On 16 September 2021, Council at its Ordinary meeting resolved to agree to a request to assess
an application for Commercial Business Type 1 Office and Commercial Business Type 2 Medical
on future lot 22, being the subject site, under the Superseded Planning Scheme (Noosa Plan
Page 24 of 122
Section 25
GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
2006). The current application has been made in response to this agreement and seeks approval
for Commercial Business Type 1 Office, and Commercial Business Type 2 Medical.
The application generally complies with the Noosa Plan 2006 except with regards to the acceptable
solutions for front setback, building height, wall length and landscaped setback. The elements of
non-compliance are supported on the basis that they will not detract from the amenity of the area
as the building provides a positive design contribution to the entry of Noosa Civic and comply with
the outcomes of the Noosa Plan 2006 and/or the Noosa Plan 2020.
Accordingly, the application is recommended for approval subject to conditions.

EXECUTIVE SUMMARY
The Local Government Act 2009 and Local Government Regulation 2012 require Council to
undertake regular reviews of the adopted budget to ensure it remains reflective of planned activities
to be funded through the financial year. This first budget review for the 2022/23 financial year (BR1)
incorporates:
• Any capital or operating projects that were incomplete with unspent budgets at the close of
the 2021/22 financial year and are eligible for carryover into the current budget year.
• Any new or emergent actions arising from Council resolution, Executive Team or Capital
Works Executive action since the adoption of the original budget in June 2022.
In summary the budget review is proposing to decrease Council’s operating position by $865k;
reducing from a $147k surplus down to a $718k deficit. Capital grant revenue has increased by
$6.3 million and the revised capital expenditure program has increased by $15.1 million to $57.1
million.
Item Original Budget Adjustments Proposed Budget
($’000) ($’000) (BR1) ($’000)
Operating Revenue $118,213 $204 $118,417
Operating Expenditure $118,066 $1,069 $119,135
Operating Result $147 ($865) ($718)
Capital Grants and Contributions Revenue $14,313 $6,322 $60,635
Capital Works Expenditure $42,024 $15,089 $57,113
RECOMMENDATION
That Council note the report by the Manager Financial Services (Acting) to the General Committee
Meeting dated 15 August 2022 and approve the proposed changes to the budget and schedule of
fees and charges for the 2022/23 financial year as outlined in this report and the Revised Budget
Financial Statements attached to the report.
REPORT
Section 170(3) of the Local Government Regulation 2012 allows Council, by resolution, to amend
the budget at any time before the end of the financial year.
The key criteria for budget reviews include:
1. Council must aim for compliance with its Financial Sustainability Policy.
Section 36
GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
2. Any eligible capital or operating project must be underway with a commitment to deliver and
complete the project.
3. Capital submissions will be reviewed and authorised by the Executive Team before inclusion
as a budget review submission, where the group will consider justification for the request,
deliverability as well as organisational and community priorities before endorsing any capital
works.
4. All operating and capital submissions for additional spend, reallocation of savings or
additional revenue will be confirmed by the Executive Team based on business risk
assessment.
The revised statement of comprehensive income, included as Attachment 4, identifies the financial
statement line items that have been affected by the proposed budget adjustments. The budget
financial statements, included in Attachment 5, also identify the impact of the proposed budget
adjustments to Council’s financial sustainability indicators.
1. Operating Budget Adjustments and Carryovers
Funding Capacity for Operational Carryovers – Prior Year Position
To inform the determination of maximum threshold for operational carryovers, the following table
summarises the 2021/22 draft full year operating financial result. It identifies a $9.0 million surplus
in 2021/22. This surplus provides additional funding for emergent (general rate funded) budget
adjustments and is set as the target ceiling of funding available for carryover. This ensures that
cash reserves are not eroded in accordance with the Financial Sustainability Policy. In particular,
it identifies $0.9 million in grant monies received last financial year that are still to be spent on
required programs and a further $3.8 million in unconstrained operating surplus.
Actual
Item
$m
General business operating position (unconstrained funds) $3.8
Significant Grant Prepayments – FAG & Disaster (constrained
$2.3
funds)
Other operating grants paid upfront and not fully spent $0.9
Unspent levies operating position (constrained funds) $2.0
Total Council Operating Position $9.0
It should be noted that the Australian Accounting Standards provide guidance on a case-by-case
basis on the accrual accounting recognition of grant revenue to determine whether grant monies
are recognised upon receipt or upon utilisation.
Proposed Budget Adjustment for Operational Carryovers
The proposed operational carryover budget adjustments will result in a $865k decrease to
Council’s operating position. The following table summarises the operational carryovers by type of
funding, with a detailed list contained in Attachment 1. It is noted that the majority of budget
submissions are grant or levy related programs and projects, whereas noted in the previous table
funds had already been received last year. There is no long-term cash flow implication for Council
as it is reflective of timing of spend revenue and expenditure between financial years.
Section 37
GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
The financial statements in Attachments 4 and 5 also outline the revised budget position.
Type Submissions Expense Revenue

Grant Funded 20 892 (204)
Levy Funded 1 43 -
General Revenue Funded 3 133 -
Total 24 1,069 (204)
The $865k in net carryovers will reduce Council’s operating surplus to a $713k deficit. This outcome
is consistent with the outcomes in prior financial years; in comparison for the 2021/22 budget
Council went from a $309k to a $692k deficit in BR1. Future budget reviews during the year (BR2
and BR3), will capture emergent YTD savings or additional revenue to ensure the mitigation of any
deficit to achieve a surplus by end of financial year in line with the Financial Sustainability Policy.
2. Capital Budget Adjustments and Carryovers
Funding Capacity for Capital Carryovers – Prior Year Position
To inform the determination of maximum threshold for capital carryovers, the following table
summarises the 2021/22 full year financial result for the capital works program. It identifies a total
unspent 2021/22 budget of $12.3 million, which is set as the target ceiling of funding available for
carryover. This ensures that cash reserves are not eroded in accordance with the Financial
Sustainability Policy.
Item Amount
($’000)
Current Budget 2021/22 (BR2) $48,079
Total Expenditure 2021/22 $35,702
Total Unspent $12,377
In addition, the operating surplus also comprises $3.8 million on unconstrained operating surplus
that is set aside in reserves for funding any emergent capital works.
Proposed Budget Adjustments for Capital Carryovers and Emergent Works
A total of 68 existing projects have been proposed for carryover from the 2021/22 year with a total
value of $11.1 million. In addition, a total of 19 variations and emergent works submissions with a
project budget of $4.0 million are proposed for inclusion in the revised budget. These variations
and emergent works have primarily been funded through grants and subsidies, including
progressive recognition of the community stimulus package grant (SEQCSP), BBRF grant for
McKinnon Drive Sports Complex Stage 2 and a number of recently successful QRA Black Summer
bushfire resilience projects. Many of these are fully funded and require no Council cash
contribution.
The total proposed capital works adjustment is $15.1 million, as outlined in the table below.

Tourism and Economic Development Investment Summary
Council resolved to report on a monthly basis, investment details for tourism and economic
development. Expenditure at 31 July 2022 is outlined below:
Expenditure Annual Budget YTD Budget YTD Actual YTD Variance
$m $m $m
Payment to Tourism Noosa $2.65 $- $- -
Economic Development $1.19 $0.08 $0.13 ($0.05)
Total $3.83 $0.08 $0.13 ($0.05)
No instalments payable under the Tourism Noosa agreement for the 2022-23 financial year have
been made. Work on the renewal of the current agreement, which was extended for 12 months to
30th June 2023 will commence in the coming months.
Economic Development expenditure is above budget due to the timing of the budget profiling for
the delivery of Destination Management Plan, this variance will resolve over time as the budget
aligns with actual expenditure.
Tourism and economic development activity is funded through the general rate, with 5.8% of the
annual general rate committed towards tourism and economic development. Should actual general
rate revenue fall below budget, this does not impact Council’s contractual commitment to fully fund
all tourism and economic development activity. Any general rate revenue shortfall is funded
through other general revenue sources to ensure all planned activities are undertaken in full.
Capital Revenue
YTD capital revenue of $0.7 million received comprises cash contributions from developers ($51k)
and capital grants ($645k). Note that the timing of capital grant receipts are generally dependent

receipt of developer contributions (both cash and contributed) is unpredictable.

Cash Management and Investment Performance
Total cash on hand at the end of July was $95.8 million. Included in this balance are funds held in
trust and for restricted purposes (e.g. unexpended levy and grant funds), prepaid grants including
the financial assistance grant and other capital works grants, prepayment of Waste Levy subsidy
(4 years), and unspent monies committed for funding capital projects which are underway and will
continue during the financial year.
The following pie charts present the mix of cash held at July 2022 by agency (graph on the left)
and by credit risk rating (graph on the right). All funds have been invested in accordance with the
Page 63 of 122

GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2022
Investment Policy and in consideration of the principles of ethical investment, preservation of
capital, return on investment and counterparty thresholds.
Figure 6: Closing Cash Held by Agency and Credit Rating
The following chart monitors the 12 month trend on total cash and the agencies invested. The bi-
annual issue of rates and levies occurred in July, which will increase cash balances from July
through August. Coinciding with RBA rate increases, commercial bank term deposit interest rates
are beginning to rise and are currently offering a much higher yield than the QTC cash rate. During
July, $30 million was placed in term deposits to maximise Council’s return on its cash holdings.
These investments were made in line with Council’s Investment of Surplus Funds policy.
Management will continue to monitoring short term investment rates to identify further opportunities
for investment as rates cash flow continues through August and interest rates continue to move.
