RE: Response to Information Request MCU23/0109, OPW23/0123,
RAL23/0017 – 20 Kauri St, Cooroy

Council issued a further advice request on 4 October 2023. The applicant provides the
following additional information in response to the items:

   1. Provide amended plans increasing the rear setback to both levels to a
      minimum of 6m, including any roofed outdoor area.

The rear units 8-10 are orientated to maximise privacy and amenity - with the
outdoor living areas on the ground floor facing the bushland to the west. The
attached arborist report addresses the Council’s concerns about the protection of
the large trees within the adjoining bushland reserve.

The relevant Performance Outcomes pertaining to setbacks seeks for the design
to:
      - Provide a high level of amenity to users of the subject site and adjoining
          premises, including provision of visual and acoustic privacy;
      - Not unreasonably obstruct views or cause overlooking of private open
          space or habitable areas of adjoining premises;
      - Provide adequate distance from adjoining land uses;
      - Preserve existing vegetation that will help buffer development;
      - Allow for space and landscaping to be provided between buildings
          including adequate area at ground level for landscaping with trees,
          shrubs, outdoor living and utilities;
      - Be consistent with the predominant character of the surrounding area;
          and protect the natural character and avoid adverse impacts
          on ecologically important areas such as national parks, waterways and
          wetlands.

The first floor is setback an average of 5m and the ground floor is setback 2.5m
from the bushland reserve. The proposed setback is consistent with the existing
unit development at 26 Kauri St and 16 Lake Macdonald Dr. The units at 26 Kauri
St are 2 storeys and setback 2m from the adjoining bushland reserve, as shown
below.

Figure.2 – Pictures of units at 26 Kauri St with a setback to the rear of 2m.

A 2m fence is proposed along the western boundary, with feature canopy trees
and screening landscaping proposed along the western boundary with the
adjoining bushland reserve. The design provides for a high level of amenity to
residents of the small dwelling units, as well as the adjoining residential and
community uses. The design is in accordance with the Performance Outcomes
and Council should not consider the Acceptable Outcome as a rule, rather take
into the individual circumstances of the site, design and constraints.

                                                                                Page 2 of 4

   2. Provide amended plans providing carparking in accordance with AO13 of the
      Dual Occupancy and Multiple Dwelling Code.

AO6.1 and 6.2 seeks for 1 carparking space per unit and 1 visitor bay per 4 units, with
motorcycle spaces able to be provided in lieu of parking spaces at the rate of 2 per 0.5
car parking spaces. The application is for 10 small dwelling units, which requires 12.5
carparking spaces.

12 carparking spaces are provided with 2 motorbike spaces provided within common
property at the front of the site. The proposed layout and parking demonstrates compliance
with the Acceptable Outcomes and the likely number of users and their guests for the long
term accommodation activity.
