Assessment Type Representations made to original approval
1. BACKGROUND
A development approval for an Other Change to Development Approval (12637DA) to include
Group Farm Stay Accommodation (undefined use) and associated supporting infrastructure
(maximum 88 beds), situated at 59 Kabi Rd Cootharaba was issued on 19 December 2024
The applicant suspended the appeal period and made representations on 14 February 2025 to the
development approval conditions. The representations are detailed below, primarily focusing on
deleting or amending various conditions, such as Biological Farmers accreditation requirements,
fire access track plans, and on-site buses. Additionally, conditions regarding building height,
vegetation removal, and external works upgrades are requested to be updated to align with current
standards and the reduced scale of the development.
At the time the application was publicly notified 2 properly made submissions were received. The
submitters were primarily concerned with validity of the existing approval, scale and intensity,
consistency with the zoning intent and character and impacts on agricultural land.
2. ASSESSMENT
An assessment in relation to each of the submitted representations is provided below:
Existing Condition 44
44. The owner/operators of the proposed development are required to be members of the
Biological Farmers of Australia. Accordingly there is not be any use of non-organic chemicals on
the site.
Applicant’s Request
The applicant has requested existing condition 44 be deleted due to changes within the
associations covering organic farm.
Assessment of Request
No objection is raised to the deletion of the condition as existing conditions detail that the golf
course is to be undertaken as part of an Agricultural (permaculture) use whilst new conditions have
been imposed that refer to the development to be consistent with the recommendations of The
Permaculture, Syntropic and Regenerative Agriculture Food Systems report included as part of the
application. The request is supported.
Recommendation
It is recommended existing condition 44 be deleted.
Existing Condition 57
57. The Group Farm Stay Accommodation and Associated Activities use lapses if the use has
not happened by 19 December 2026 unless an application to extend the currency period is
approved by Council.
Applicant’s Request
The applicant has requested existing condition 57 be amended and the currency period be
extended to 6 years from decision taking effect. The applicant indicates that this is in accordance
with the planning act for MCU approvals, as well as allowing time to construct buildings and
infrastructure.
Assessment of Request
No objection is raised to the change to condition to reflect current legislative time frames.
Recommendation
Document Set ID: 23659436
Version: 9, Version Date: 23/04/2025
Page 3
It is recommended existing condition 57 be amended to read as follows:
57. The Group Farm Stay Accommodation and Associated Activities use lapses if the use has
not happened by 19 December 2026 7 March 2031 unless an application to extend the currency
period is approved by Council.
Existing Condition 58
58. Plan amendments - Plan to be amended to incorporate the recommended fire access trail
within Lot 394 M371117 (see Plate 23 of the Bushfire Hazard Assessment and Management Plan)
and extending along the southern boundary until it meets the eastern boundary of the subject site,
before gaining access to Road 176. The fire access is to be detailed a being used for emergency
access only.
Applicant’s Request
The applicant details that the updated plan attached to this request includes the link to Cootharaba
Downs Rd. The applicant indicates that this condition can be deleted or amended to insist on the
use as an emergency access only.
Assessment of Request
The relevant plan has been amended as required and no objection is raised to the change to
condition.
Recommendation
It is recommended existing condition 58 be amended to include the following plan in the plan table:
Plan No. Rev. Plan/Document Name Date
A-DA-01.03 15 Proposed Whole Site Plan prepared by 17/02/2025
Elevation Architecture
Existing Condition 66
66. Buses capable of evacuating all patrons during an emergency event are to remain on site
whilst the Group Farm Stay Accommodation is in operation.
Applicant’s Request
The applicant has requested existing condition 66 be deleted. The applicant indicates that all
infrastructure is located outside of the bushfire hazard and buffer areas and that there is no
requirement in the bushfire management plan to keep buses onsite and is an unreasonable
imposition. Furthermore, the applicant indicated that there is a recommendation for a shelter in
place requirement in the bushfire hazard plan as described in the bushfire addendum (See
attached commentary from North Coast Environmental).
Assessment of Request
Concerns were raised during assessment of the proposal that a large number of children may
potentially be put in a situation where they are impacted by a fire event. As a result a Bushfire
Evacuation Plan (BEP) was submitted as part of the original application. The BEP was designed
to assist management to protect life and property in the event bushfire threatened the proposed
development.
Councils Senior Environment Officer reviewed the original BEP and indicated that the document
aimed to establish pre-planning guidelines for evacuation of the premises where there was a need
to relocate personnel from one place to another to enhance the protection of those people. The
Page 3 of 13
Document Set ID: 23659436
Version: 9, Version Date: 23/04/2025
Page 4
BEP included evacuation triggers to initiate emergency actions to be taken as the Fire danger
rating increases.
The BEP was reviewed by Councils external bushfire consultant who indicated that Evacuation
triggers should be conditioned to incorporate a more conservative approach and include the
evacuation of all guests and non-essential staff prior to the commencement of any day with a
forecast FDR rating of Extreme or Catastrophic.
To enable evacuation of the 88 patrons who may have been transported to the site by bus and
have no alternative form of transport off the site during Extreme or Catastrophic rating periods
condition 66 was imposed to require buses to remain on site.
As the BEP refers to Extreme or Catastrophic FDR ratings, is it considered reasonable to amend
the condition to require buses to be located on site during these ratings.
Recommendation
It is recommended existing condition 66 be amended to read as follows:
66. During Extreme or Catastrophic Fire Danger Ratings (FDR), buses capable of
evacuating all patrons must remain on site whilst the Group Farm Stay Accommodation is
in operation.
Existing Condition 68
68. External design features, materials and finishes must be as shown on the Approved Plans,
with no inclusions or alterations made without approval in writing by Council.
Applicant’s Request
The applicant has requested existing condition 68 be amended to include the word ’generally’ to
allow scope with construction and small substitutions.
Assessment of Request
No objection is raised to the change to condition to include the word generally.
Recommendation
It is recommended existing condition 68 be amended to read as follows:
68. External design features, materials and finishes must be as generally shown on the
Approved Plans, with no inclusions or alterations made without approval in writing by Council.
Existing Condition 76
76. The maximum height of the development must not exceed 7 metres above the ground level.
Applicant’s Request
The applicant has requested existing condition 76 amended to detail the height allowance of 8
metres as part the Noosa Plan.
Assessment of Request
The condition was imposed to reflect the submitted plans. No objection is raised to the proposed
change as it will be consistent with the scheme requirements.
Recommendation
It is recommended existing condition 76 be amended to read as follows:
76. The maximum height of the development must not exceed 7 8 metres above the ground
level.

Existing Condition 81
81. The development site must be landscaped / rehabilitated. The works must be undertaken in
accordance with an Operational Works approval and the Noosa Plan for that specific area and
must include in particular:
(a) A waterway rehabilitation plan that is developed to reinstate a native vegetation buffer along
the waterway to manage water quality and provide riparian habitat for local flora and fauna.
(b) A waterway rehabilitation design that maintains inflows into VC1a rainforest unit to sustain the
current assemblage of flora species and habitat conditions under the current waterway conditions
(c) management of all weeds species listed in the following standards and legislation:
i. declared plants under the Land Protection (Biodiversity Act 2014 and subordinate Regulation
2016).
ii. Non-scheduled invasive species listed in the Noosa Biosecurity Plan 2020.
Applicant’s Request
The applicant has requested existing condition 81 be amended to remove the section relating to
the rehabilitation of the waterway as the deepening and widening of the waterway for canoeing is
no longer proposed.
Assessment of Request
The request is supported as works are no longer proposed in the waterway. Councils Senior
Environment Officer recommends that the weed management portion of the condition be updated
to reflect the management of weeds on the site.
Recommendation
It is recommended existing condition 81 be amended to read as follows:
81. Plant pest (weeds) must be managed to:
a. Ensure declared plants under the Land Protection (Biodiversity Act 2016 and sub-
ordinate Regulation 2016) are controlled and prevented from spreading.
b. Oversee management of environmental weeds identified in the Noosa Biosecurity Plan
2020, utilising techniques that minimise regrowth, prevent damage to non-target
species, retain conservation values and maintains site stability.
Existing Condition 86
86. Vegetation must only be removed or disturbed in accordance with a Fauna Management
Plan (or part thereof) prepared by a qualified person* and endorsed through an Operational Works
approval.
Applicant’s Request
Document Set ID: 23659436
Version: 9, Version Date: 23/04/2025
Page 6
The applicant has requested existing condition 86 be amended or clarified to ensure the condition
relates to native vegetation removal only. The applicant notes that the site includes existing
orchards that are used for commercial produce.
Assessment of Request
No objection is raised to the request.
Recommendation
It is recommended existing condition 86 be amended to read as follows:
86. Native vegetation must only be removed or disturbed in accordance with a Fauna
Management Plan (or part thereof) prepared by a qualified person* and endorsed through an
Operational Works approval.
Existing Condition 88
88. The development must be carried out in accordance with Bushfire Evacuation Plan v4
prepared by North Coast Environmental Services and dated 06/09/2024, which must be amended
as follows:
a. Revised plans that that incorporate the latest architectural plans that shows the internal
evacuation route that connects directly between the shelter in place building and the clamping
infrastructure.
b. Section 8 Evacuation Triggers, to be updated to include:
i. Daily review of FDR forecasts for the Southeast Coast which are available from the Bureau of
Meteorology
ii. Evacuation of all guests and non-essential staff prior to the commencement of any day with
a forecast FDR rating of Extreme or Catastrophic.
Applicant’s Request
The applicant has requested existing condition 88 be amended requesting that the words Extreme
should be removed. Supplementary information from North Coast Environmental states that pre-
emptive evacuation of a site is only reference under FDR Catastrophic and therefore condition
88b(ii) is inconsistent with the AFDRS official advice.
Assessment of Request
Councils Senior Environment Officer has advised that the bushfire addendum by North Coast
Environmental references the Australian Fire Danger Rating System. The applicant wishes to
remove the trigger of Extreme, however given the vulnerable use and the type of occupants it is
considered more appropriate to trigger evacuation/no new guests when the fire danger rating is
Extreme and Catastrophic. Further it is noted that Councils external fire expert recommended
inclusion of this condition.
Recommendation
It is recommended existing condition 88 remain unchanged.
Condition 96
96. The existing intersection joining Cootharaba Road with Kabi Road must be upgraded to
include a sealed Basic Right Turn Treatment. The works must be undertaken in accordance with
an Operational Works approval, be generally in accordance with section 7.2 of Austroads’ A Guide
to Road Design Part 4A, sections 5, 6 and 8 of BMC Traffic’s Traffic Engineering Assessment
Report (Doc ID: 22354477) dated 22 March 2023, The Noosa Plan 2020 – PSP6 Engineering
Design Standards, and include, but not be limited to:
a. a design prepared by a suitably qualified person (RPEQ);

Version: 9, Version Date: 23/04/2025
Page 7
b. adequate manoeuvring about the intersection for a 12.5m and 14.5 rigid vehicle, so
that no part of the rigid vehicles exits the traffic lane(s); and
c. widening of Kabi Road in accordance with Condition 97.
Applicant’s Request
The applicant has not proposed to amend Condition 96 however seeks clarification on how
Condition 96 is to be administered with respect to Condition 12 of the original approval.
Assessment of Request
Condition 12 was imposed as part of the original golf course approval and required the payment of
a contribution towards external works in the area. This contribution would have been paid when
the original use commenced circa 2005 and the contribution used for works in the area.
Condition 96 relates to upgrades to the Kabi Road intersection which are necessitated by the
current proposals to increase the use on the site. No justification or changes were provided by the
applicant and no change is recommended to Condition 96.
Recommendation
It is recommended existing condition 96 remain unchanged and condition 12 be amended to refer
to the original golf course use as follows:
12. A contribution toward roadworks external to the development site in the Cootharaba Road
catchment shall be paid prior to the commencement of the Integrated Permaculture Designed
Organic Orchard and Golf Course Complex. The amount of the contribution as at September
1999 is $100,000 and shall be subject to changes in the Consumer Price Index, All Groups
Brisbane, up until the date of payment.
Condition 97
97. Kabi Road must be upgraded for the full length of the road (i.e., between 59 Kabi Road and
Cootharaba Road). The works must be undertaken in accordance with an Operational Works
approval, be generally in accordance with Austroads’ A Guide to Road Design Part 3, sections 5,
6 and 8 of BMC Traffic’s Traffic Engineering Assessment Report (Doc ID: 22354477) dated 22
March 2023, The Noosa Plan 2020 – PSP6 Engineering Design Standards, and include, but not
be limited to:
a. a design prepared by a suitably qualified person (RPEQ)
b. combined traffic lane width of 6.2m (2 x 3.1m);
c. a shoulder width of 1.0m (with a minimum shoulder sealed width of 0.5m);
d. a pavement design suitable to cater for heavy vehicles (i.e.,rigid vehicles, buses, etc.);
e. all associated drainage infrastructure (i.e., table drain, culvert, etc.);
f. the continuation of the existing stormwater box culvert to allow for the require carriageway width;
g. considerations to the existing residential driveway crossovers; and
h. a sealed turnaround facility sufficiently sized to accommodate a 3-point turn manoeuvre of a
heavy rigid vehicle (HRV) located at the end of the road.
Applicant’s Request
The applicant has request to delete Condition 97 to reflect the reduced scale of the development
and is supported by a Traffic Memorandum prepared by BMC Traffic.
Assessment of Request
Engineering Assessment

Version: 9, Version Date: 23/04/2025
Page 8
As part of the original 1998 approval and prior to the commencement of use, the applicant was
required to upgrade Kabi Road to a nominal sealed width of 6m and a 1m gravel shoulder either
side, for a total carriageway width of 8.0 metres. This complies with Council’s PSP6 Engineering
Design Standards for a Local, Rural Road. The Traffic Memorandum by BMC assumes these
works were completed but aerial imagery suggests this is not the case.
The Traffic Memorandum prepared by BMC Traffic reports that the reduced scale of the
development will generate an overall reduction in vehicles per day (vpd) on Kabi Road. The
reported peak, repeatable 85th percentile event is now reduced from 167 to 97.3 vpd.
This reduction in vpd lowers the prescribed standard of Kabi Road. The matter has been referred
to Infrastructure Planning, Design and Delivery who, in conjunction with Engineering, are generally
accepting of the rationale to avoid the widening as described by Austroads’. However, Kabi Road
does not comply with the originally imposed Condition 13 and still proposes to intensify the use of
Kabi Road by generating additional passenger bus (and other ‘heavy’ vehicles) movements.
With Infrastructure Planning, Design and Delivery’s support, Engineering is generally willing to
accept a reduction to the extent of upgrades to Kabi Road. The upgrades must generally comply
with PSP6 Engineering Design Standards, Condition 13 and minimise the risk for conflict between
passenger and ‘heavy’ vehicles. It is recommended that, at a minimum, Kabi Road is upgraded to
allow for safe passing opportunities by providing a nominal carriageway width of 8m and a minimum
sealed lane width of 6m.
Additionally, Engineering recommends that the requirement to extend the existing culvert is
removed as it could be considered unreasonable due to the reduced extent of upgrades to Kabi
Road.
Recommendation
It is recommended existing condition 97 be amended to read as follows:
External Works – Kabi Road
97. Prior to the commencement of the Group Farm Stay Accommodation use Kabi Road must be
upgraded for the full length of the road (i.e., between 59 Kabi Road and Cootharaba Road). The
works must be undertaken in accordance with an Operational Works approval, be generally in
accordance with Austroads’ A Guide to Road Design Part 3, sections 5, 6 and 8 of BMC Traffic’s
Traffic Engineering Assessment Report (Doc ID: 22354477) dated 22 March 2023, The Noosa
Plan 2020 – PSP6 Engineering Design Standards for a “Rural, Local” road, and include, but not
be limited to:
a. a design prepared by a suitably qualified person (RPEQ);
b. a combined sealed traffic lane width of 6.2m (2 x 3.1m) 6.0m;
c. a gravel shoulder width of 1.0m (with a minimum shoulder sealed width of 0.5m);
d. a pavement design suitable to cater for heavy vehicles (i.e., rigid vehicles, buses, etc.);
e. all associated drainage infrastructure (i.e., table drain, culvert, etc.);
f. the continuation of the existing stormwater box culvert to allow for the required carriageway
width deleted.;
g. considerations to the existing residential driveway crossovers; and
h. a sealed turnaround facility sufficiently sized to accommodate a 3-point turn manoeuvre of a
heavy rigid vehicle (HRV) located at the end of the road.
Existing Condition 98
98. The development site must be provided with an Emergency Bushfire Evacuation Route
connecting to Council’s “Road 176”. The emergency route is to be used for emergencies only and
is not to be used for deliveries or general access. The works must be undertaken in accordance
with an Operational Works approval and Section 5.5 of North Coast Environmental Services’

Page 9
Bushfire Hazard Assessment and Management Plan (J001061, v.4) dated 11 September 2024,
and include, but not be limited to:
a. a design prepared by a suitably qualified person (RPEQ) that is to an acceptable standard to
cater for a HRV, 14.5m rigid vehicle (i.e., bus) and appropriate firefighting appliances;
b. a design that allows for unbroken access for a HRV, 14.5m rigid vehicle (i.e., bus) and
appropriate fire-fighting appliances through the site (i.e., from “Road 176” to all parking and
manoeuvring areas and through to Kabi Road);
c. a design that includes passing bays and turning areas;
d. the emergency route, all internal roads and associated manoeuvring areas must not exceed a
gradient of 12.5%;
e. the emergency route must have a maximum cleared width of 10.0 metres and a minimum cleared
width of 6.0 metres; and
f. the necessary upgrades to “Road 176” and associated drainage infrastructure, which must be
maintained by the applicant during the life of the development.
g. Consultation must occur with the existing resident(s) that access “Road 176” in relation to the
proposed works.
Applicant’s Request
The applicant has requested existing condition 98 be amended to a much lesser standard
submitting that their traffic consultants BMC Traffic and Recor Consulting Engineers advised that
a single lane access track of compacted gravel without passing bays would be appropriate.
Assessment of Request
Engineering Assessment:
The applicant is requesting to construct the Fire Access Trail to a “much lesser standard” following
advice from their Traffic Engineer who has suggested that “standard road design requirements …
are not directly applicable for an emergency access road”. The Fire Access Trail must be designed
to accommodate a HRV, 14.5m rigid vehicle (i.e., bus) and appropriate fire-fighting appliances.
Engineering does not support the proposed change to “a.” to reduce the standard of the Fire
Access Trail.
The request to clarify that the Fire Access Trail is to be used “in the event of a fire emergency only”
does not take away from the original intent of the condition. Engineering is generally supportive of
this change to ‘a’.
Engineering recommends that the request to remove the need to provide passing bays and turning
areas as part of the Fire Access Trail is not supported. This would be contrary industry standards
and the recommendations of the Bushfire Report.
The request to clarify part ‘f’ by the inclusion of the word “necessary” upgrades does not add or
clarify the original intent of the condition. Engineering is not supportive of this change to “f.”.
Recommendation
It is recommended existing condition 98 be amended to read as follows:
Fire Access Trail
98. The development site must be provided with an Emergency Bushfire Evacuation Route
connecting to Council’s “Road 176”. The emergency route is to be used for emergencies only
and is not to be used for deliveries or general access.
The works must be undertaken in accordance with an Operational Works approval and
section 5.5 of North Coast Environmental Services’ Bushfire Hazard Assessment and
Management Plan (J001061, v.4) dated 11 September 2024, and include, but not be limited
to:

a. a design prepared by a suitably qualified person (RPEQ) that is to an acceptable
standard to cater for a HRV, 14.5m rigid vehicle (i.e., bus) and appropriate fire-fighting
appliances in the event of a fire emergency only.
b. a design that allows for unbroken access for a HRV, 14.5m rigid vehicle (i.e., bus) and

g. Consultation must occur with the existing resident(s) that access “Road 176” in relation
to the proposed works.
3. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme. The
requested changes to the conditions do not raise any significant issues and are therefore
supported. The application is therefore recommended for approval.
The report is provided in accordance with Section 76 of the Planning Act 2016.

a. Condition 88 is a reasonable and relevant condition as the proposed use is a
vulnerable use and patrons are required to be evacuated when the fire danger rating
is Extreme and Catastrophic as this mitigation strategy is aligned with QFES
guidance material.
Condition 96 relates to upgrades to the Kabi Road intersection necessitated by the
current proposal and increase to the number of patrons using the site.
