Attention: Glen Conforti, Planning Technical Officer

Dear Glen

PROPOSED ‘PEREGIAN BEACH VILLAS’ AT 226 DAVID LOW WAY, PEREGIAN BEACH
DESCRIBED AS LOT 12 ON SP 207105

Reference is made to the submissions received during the public notification period for the
abovementioned development. Many of the issues raised in the submissions in objection to
the development have been addressed in the application material. However, the following
further comments are provided in response to the key issues raised and given that changes
have been made to the design during the information request period.

Built Form – Density

The subject site has an area of about 1,200m². The density provided under the planning
scheme is 100 persons per hectare, which equates to 12 persons. The proposed development
was amended in response to the information request and now nine (9), one (1) bedroom
dwelling units are proposed. Changes have also been made to the internal design of the
dwelling units, which will ensure that the proposed units will remain one (1) bedroom. This
means that the proposed development has a theoretical population density of 15.3 persons.

Importantly, the existing motel approval over the land, which remains current, has a theoretical
population density of 18.2 persons. While the proposed development exceeds the allowable
density under the planning scheme, it is less than the current motel approval over the land,
which is a relevant consideration.

The population density now proposed is considered reasonable given the nature of the
development being for one (1) bedroom units, for which there is a strong demand. This is
based on the number of enquires received from the general public and the number of
expressions of interest received, with limited marketing being undertaken.

Built Form – Height

The subject land is relatively flat and the proposed development is two (2) storeys and has a
height of about 7.661m from the finished ground level to the ridge of the roof (refer elevation
drawings for Units 4 & 5).

All of the proposed units have the same roof design and will be below the 8m height
requirement. To this end, a condition can be imposed to ensure that the proposed
development does not exceed a height of 8m from both the natural and finished ground level.

Built Form – Setbacks

The planning scheme requires the following building setbacks as a probable solution, which
makes reference to Schedule 1, which states:

       a) for 1 or 2 storey building – 6m; or
       b) for 3 storey building – 6m for the first 2 storeys and 10m for the third storey
       Side boundaries—
       a) 1.5m setback up to 4.5m height;
       b) 2m setback between 4.5m - 7.5m height; and
       c) 2m plus 0.5m for every 3m above 7.5m height or part thereof
       Rear boundary—6m.

The proposed development generally meets the side boundary setbacks to the northern
boundary, with Units 1 to 3 being setback about 1.6m at ground level and 2.6m at the first
level.

The proposed development generally meets the building setback to the north-eastern
boundary of the site, with Units 4 being adjacent to the easement and about 2.4m from this
boundary.

The proposed development encroaches into the rear setback in a minor way, being about
5.875m from the rear boundary for the deck area at the first floor, with the separation wall
between the units being setback about 5.4m at ground level. This reduced building setback is
considered to be relatively minor encroachment that will not cause adverse amenity impacts
upon neighbouring properties, because sufficient separation is still achieved.

The proposed development will encroach within the side boundary setbacks on the southern
side near the ‘Peregian Boardwalk’ development. However, this is considered acceptable
given the ‘Peregian Boardwalk’ development is mostly comprised of commercial uses. Further,
the actual building separation will be more than 6m, given the driveway and access to the
‘Peregian Boardwalk’ is provided along this boundary, with the existing building setback from
the boundary. Consequently, sufficient separation is provided between the buildings when
viewed from the street and no adverse amenity impacts will be caused.

The proposed development does encroach within the front building setback area, but this is in
part only. While the setback is about 4m at the closet point, this is for a small portion of Unit 1
only.

In this case the allotment has an irregular shape and is also constrained by easements.
Importantly, the encroachment is mainly caused by the provision of a desirable building form
being four (4) separate buildings, rather than a single bulky building. Further, the setback to
the David Low Way frontage is generally consistent with the reduced building setback to the
‘Peregian Boardwalk’ development. It is suggested that given the landscaping proposed to the
frontage and the proposed built form being of light weight construction comprising separate
buildings, the reduced building setback will not adversely impact upon the streetscape.

Building Form – Site Cover and GFA

The proposed development has a site cover of 39.8%, which is in compliance with the planning
scheme. It is accepted that the gross floor area of the building exceeds the allowable GFA

                                                                                        2|Page

under the relevant outcome of the planning scheme, being more than 480m². However, it is
important that the proposed development with a GFA of about 527m², is generally consistent
with the current motel approval over the land, which has a GFA of about 528m². Further, the
proposed development is compatible with surrounding development, in particular the
‘Peregian Boardwalk’ development to the south and also other development in the locality,
including the office development on the western side of David Low Way. Consequently, the
proposed development will not be out of character at this location.

Given the nature of the proposed building design, being comprised of a number of separate
smaller buildings, the development will not present as having excessive bulk to adjacent
properties and will not adversely impact upon the streetscape or cause visual amenity impacts
generally. The proposed built form is considered to be of a domestic scale and appearance
generally.

Sufficient Grounds

It is intended that the proposed development be utilised for both permanent residential and/or
visitor accommodation. The scale of development is compatible with other development in the
locality, will not cause adverse amenity impacts and will not be out of character.

The nature of the development is such that it provides for one (1) bedroom dwelling units in
close proximity to the Peregian Beach Village Centre, which is a desirable planning outcome.
The development will provide for additional housing choice and will be of considerable benefit
to the general community. Consequently, it is suggested that there are sufficient grounds to
overcome any conflict with the planning, which must be considered minor and is of a technical
nature only.

Should you have any questions with respect to the above, please do not hesitate to contact
me direct.

Yours faithfully

Shane Adamson
