1.1. Background
On 16 January 2003, a Development Permit for Material Change of Use for Service Industry,
Warehouse and Service Shops, together with a Reconfiguring a Lot (12 lots) was issued (22850
DA 132002.220270.3).
Subsequent representations were made on the conditions and a Negotiated Decision was issued
10 April 2003:
Nature of change – change to MCU conditions 1, 7, 12, 16 31, 35, 39 relating to matters
                   concerning approved plans, colour scheme, existing trees cash bond, ,road
                   reserve width, street drainage, water connection) and delete condition 45
                   relating to easements over services;
                -   Change to RAL conditions 23, 24, 40 relating to matters concerning new
                    road construction, road reserve width and deleted conditions 35 & 44
                    relating to easements over services, connection to water.
Subsequent changes to the approval have been sought and determined since that time as
follows:
   22850 DA (132002.220270) – Change to an Existing Approval – 17 July 2003
     Nature of change – amend MCU Condition 49 relating to geotechnical matters and RAL
     Condition 29 relating to filling and battering of earthworks
   22850 DA (132002.220270.2) – Change to an Existing Approval - 31 January 2005
     Nature of Change – change MCU condition 3 relating to 30% landscaping area and
     condition 25 relating to car parking provision and include one additional condition restricting
     dividing fences on common side boundaries
