Proposed Material Change of Use (Multiple Housing – Type 2 Duplex)
and Operational Works
30 The Cockleshell, Noosaville
Lot 11 on RP138550
Council ref: MCU17/0563
I refer to Council’s Information Request, dated 10 January 2018 in relation to the
abovementioned development.
On behalf of the applicant, MJ Hussain & LH Randall & SM Johnson Cole & DA
Johnson, and in accordance with Part 3(13) of the DA Rules 2017, we provide a
response to all the issues raised. A response to the items raised in Councils
Information Request is outlined below:
1. A plan (to scale) that clearly details proposed R.L.s of the top of all roof
lines.
RESPONSE
Please refer to Attachment 1 - Amended Architectural Plans prepared by Icon
Building Design, specifically Sheet 05, which demonstrates the RL of the roof line of
9.904 metres. Please see Figure 1 below, which details that the height of the building
does not exceed 8 metres from Natural Ground Level.

2. A plan (to scale) that clearly demonstrates natural and finished ground surface levels. Include
details of proposed fill levels.
RESPONSE
Please refer to the Amended Operational Works Plans prepared by 360 Civil Consulting Pty Ltd (Attachment
2), specifically Sheets 04 and 05 of 12, which demonstrates the earthworks plan and sections and
demonstrate the natural ground level, as well as the finished surface levels.
In addition to this, Sheet 05 of the Amended Architectural Plans (Attachment 1) also demonstrates the
natural and finished ground surface levels.
3. Provide amended plans that clearly demonstrate compliance with the required setbacks.
RESPONSE
Please refer to the Amended Architectural Plans (Attachment 1), specifically Sheet 03 (Section A), which
demonstrates compliant side setbacks to the ground and first levels (demonstrated in Figure 2 below). It is
noted that the unit design and setbacks are consistent for all units within the development and the identified
section below is sufficient to demonstrate compliance with the side boundary setback requirements.
Building Setback Diagram
Figure 2 Building Setback Diagram (Source: ICON Building Design)
Although the development complies with the side and front boundary setbacks, the development remains non-
compliant with Probable Solution S9.1 of the Noosaville Locality Code, as the development contains a rear
boundary setback of 4.9 metres.
Despite this non-compliance, both adjoining sites are utilised for business purposes and will not be impacted,
nor will impact upon the proposed development within the setback variation, with 31 Thomas Street
containing a carpark to the rear of the site, and 33 Thomas Street containing a single storey building, which
does not include any outdoor functions between the built form and the boundary.
In consideration of the information provided above, the proposed development is compliant with Specific
Outcome O9, as:
Page 3
• The amenity of the residents is protected through the inclusion of screening and landscaping features;
• The development will not impact upon the amenity of adjoining development, given that the
proposed development adjoins business uses within the Business Centre Zone;
• The development contains sufficient space for on-site car parking;
• The development includes setbacks, which are compliant with that of existing developments to the
north and south of the subject site, which include setbacks of approximately 4.18 metres from the rear
boundary; and,
• The setback variations do not result in any impacts to any mapped ecological features.
Accordingly, the development satisfies the setback Assessment Benchmarks outlined within the Noosaville
Locality Code.
4. Provide amended plans that have considered this and demonstrate compliance with the
Noosaville Locality Code with respect to building design (particularly bulk), mix of materials,
and considers the character of Noosaville and the local and surrounding streetscape.
RESPONSE
As demonstrated in the Amended Architectural Plans prepared by ICON Building Design (Attachment 1), the
development has been redesigned such that it presents a lightweight building design, which includes hip and
gable roof lines, timber cladding and variations in design. The revised design is reflective contemporary coastal
character of the surrounding area, will suitably integrate with the existing streetscape, and presents as a
considerable improvement where compared to the original design.
In addition to the variation to the architectural style, the redesign of the development has included design
variations between the two (2) building blocks, such that 30 and 32 The Cockleshell are not a mirror design.
As a result of the architectural re-design, the development complies with all assessment benchmarks of the
Noosaville Locality Code, specifically:
Probable Solution S21.1
Through the development utilising lightweight and textured external building materials.
Probable Solution S49.1
Through the development:
• Not exceeding a maximum wall length of 15 metres, and each wall pane contains an element which
includes visual interest, specifically windows;
• Containing varied roof forms, with the use of hip and gable forms, which provide a point of difference
between each building, it is noted that the units are stacked and do not present as individual units
when viewed from the Cockleshell;
• Does not include upper level balconies, with ground level private open space provided for each unit;
• Visually breaks up the design through the application of different window and roof treatements, which
visually reduces the bulk of the building; and,
• Utilises appropriate landscaping which is reflective of the proposed development and integrates with
the streetscape.
Page 4
5. Provide amended plans that reduce the dominance and bulk of the fencing through innovative
design and include a step-in design (maximum 5 metre intervals). Refer Item 4 of this
information request.
RESPONSE
Please refer to the Amended Architectural Plans prepared by ICON Building Design (Attachment 1), which
demonstrates a varied fence design, such that no fence element contains a continuous section of more than 10
metres.
6. Provide information that provides details on practicalities of how the development will be
accessed, whether it be an access easement, or other arrangement.
RESPONSE
Upon Approval of this Development Application, a subsequent Reconfiguring a Lot application will be lodged to
establish an Access Easement over the driveway and central vehicle manoeuvring areas.
7. Provide a stormwater strategy/layout that caters for the stormwater runoffs from adjoining
properties and ensures no additional stormwater ponding or worsening of existing drainage
conditions to occur on these properties for all storm events up and including 1% AEP (1 in 100
year). This may require providing stormwater pipeline and/or defined overland secondary
flowpath within the development site to convey natural stormwater runoff from other
properties into an existing stormwater system.
RESPONSE
Please refer to the Engineering Response to Council’s Information Request (Attachment 3), as well as the
Amended Operational Works Plans prepared by 360 Civil Consulting Pty Ltd (Attachment 2), which responds to
Information Request Items 7 – 9. The specific response to Information Request Item 7 is detailed below:
‘Skyline Surveyors were able to provide additional survey, spot level information, on some areas of the
neighbouring sites. This information is attached for Council’s record. Please note that in some locations
access was not possible and Skyline obtained as best survey level information as possible. The survey
information indicates the following: -
• Lot CP BUP7701 appears to have a ridge through the middle of the site with the western portion of
the lot falling to the street and the eastern portion of the lot falling to the rear of the site. Possible
pond may occur in the north-eastern corner of the proposed development site. In order to alleviate
this possible ponding a side grated pit is proposed in the base level of the retaining wall which will be
connected to the development site’s internal drainage. This stormwater system is shown on amended
360 Civil Consulting Drawing No. 03 (Rev A).
• Lot 6 RP124554 has an internal stormwater pit and overland flow discharges to Thomas St via the
existing driveway.
• Lot CP BUP7283 is lower than the development site and the survey levels indicate it falls towards
Thomas St.
• Lot CP BUP6949 appears to be slightly lower than the development site and falls towards the street.
The north-eastern corner of Lot CP BUP6949 appears to be approximately at a similar level to the
development site and to address any possible ponding that may occur in this corner a side grated pit
is proposed in the base level of the retaining wall which will be connected to the development site’s
Page 5
internal drainage. This stormwater system is shown on amended 360 Civil Consulting Drawing No. 03
(Rev A)’.
8. Provide further information, details and/or amendments to address the following:
a. The proposed development requires filling, increases load on the existing drainage
pipeline on the site and will limit future opportunities for repair and/or upgrade.
Also, there will be an increase in the flows in the pipeline due to the proposed
development. As such, it is considered necessary that CCTV investigation of the
existing pipeline (from The Cockleshell Street to Thomas Street) be carried out by
the applicant determine the condition of the pipeline and report of investigation
submitted to Council prior to issuing the OPW approval.
b. A drainage easement must be created by the applicant over the subject stormwater
pipeline at a width in compliance with Council’s standards and guidelines. Show the
required easement on the amended plans.
RESPONSE
Please refer to the Engineering Response to Council’s Information Request (Attachment 3), as well as the
Amended Operational Works Plans prepared by 360 Civil Consulting Pty Ltd (Attachment 2), which responds to
Information Request Items 7 – 9. The specific response to Information Request Item 8 is detailed below:
a) ‘Please find attached to this response a preliminary stormwater CCTV report for the existing 375mm
stormwater pipe that runs through 32 The Cockleshell, Noosaville. The CCTV commenced at The
Cockleshell inlet pit and DrainsKleen have advised that "the survey was abandoned - camera travelled
downstream about 7m, before reaching, root mass which camera could not pass. Attempted reverse
survey from other end but unable to access pit."
The report and photos from DrainsKleen of the root mass is attached for council's information. Further
clarification from DrainsKleen regarding the reverse survey was sought and the DrainsKleen operator
who was on site has advised that: -
"I was unable to locate the downstream pit (unsure if downstream pit exists or is just cut into another
pipe). I am also unable to go from one of the neighbour pits on Thomas Street as I can't go around
corners with robot camera due to risk of damaging equipment."
Since this survey, Council have advised that, in due course, they will unblock the stormwater pipe and
that no further work by this development is required in order to address this information request item.
Reviewing the photographs provided in the DrainsKleen report the pipe that is visible appears to be in a
reasonable condition.
b) Please refer to the amended 360 Civil Consulting Drawing No. 03 (Rev 3) which details the 4m wide
drainage easement over the existing council stormwater infrastructure’.
9. Provide an engineering plan and longitudinal cross section for the access driveway/s and
crossovers that include 2.0m wide pathway and demonstrates compliance with IPWEA
Page 6
Standard Drawings RS-049 and RS-050 and have grades ensure a standard vehicle (B99),
entering or leaving the site will not scrape or bottom down.
RESPONSE
Please refer to the Engineering Response to Council’s Information Request (Attachment 3), as well as the
Amended Operational Works Plans prepared by 360 Civil Consulting Pty Ltd (Attachment 2), which responds to
Information Request Items 7 – 9. The specific response to Information Request Item 9 is detailed below:
‘Please refer to the amended 360 Civil Consulting Drawing No. 11 and 12 which detail a driveway long
section and relevant cross section drawings incorporating the 2m wide footpath and compliance with
IPWEA Drawings RS-049 and RS-050’.
10. Provide amended landscaping plans that demonstrate compliance with the minimum
landscaping requirements.
RESPONSE
Please refer to the Amended Architectural Plans (Attachment 1), specifically Sheet 2, which provides detail on
the soft and hard landscaping for each unit, as outlined below:
30 the Cockleshell
• Soft Landscaping = 115.0m2 (45.18%)
• Hard Landscaping = 139.5m2 (54.81%)
• Total = 254.5m2
32 the Cockleshell
• Soft Landscaping = 114.9m2 (45.21%)
• Hard Landscaping = 139.2m2 (54.78%)
• Total = 254.1m2
Overall, each unit block results in a minor shortfall in landscaping, with a shortfall of 9.5m2 for 30 The
Cockleshell and 9.9m2 for 32 The Cockleshell. Overall the development provides a total of 508m2 of
landscaped area, which equates to 42.2% of the consolidate site.
The development has mitigated the landscaping shortfall through providing the soft landscaping elements
to the frontage and rear of the site, as well as the adjoining northern and southern boundaries. Shortfalls to
the required landscaping are considered appropriate given the development is not able to provide
landscaping strips to the internal common boundary, given its required access arrangements. It is noted
that if the common internal boundary was capable of being landscaped, the development would comply
with the landscaping requirements. Thus, the provided landscaping strips on all other boundaries are of an
appropriate width to mitigate amenity impacts and integrate into the existing streetscape.
Despite the proposed non-compliance with Probable Solution S1.1 of the Landscaping Code, the
development satisfies Specific Outcomes O1, with the development providing sufficient landscaped area,
such that:
• The proposed landscaping enhances the visual amentiy and natural landscape character of the
area, through the development containing a significantly improved streetscape, and through the
inclusion of a mix of trees, shrubs and ground covers;
Page 7
• The existing Poinciana is required to be removed due to the central location of the tree and the
required location of the driveway and maneuvering areas, all other vegetation is required to be
removed, in place of new landscaping elements;
• The proposed landscaping assists in reducing the visual impact of the development and assists in
concealing the carparking areas associated with the development, which are integrated into the
design, such that they do not dominate the streetscape; and,
• The development contains sufficient separation and screening to adjoining development to the
north and south, as well as appropriately screening the existing office development to the east.
Accordingly, the development satisfies the intent of Specific Outcome S1.1 of the Landscaping Code.
11. Provide an amended landscape plan which uses a local native species as a feature tree at the
frontage.
12. Provide an amended landscape plan with local native species in accordance with the landscape
and Planning Scheme Policy 3 landscaping Plants and Guidelines of the Noosa Plan.
13. Provide an amended landscape plan demonstrating sufficient volumes of planting media,
above ground volume and drainage for the proposed species.
RESPONSE
Please refer to the Amended Landscaping Plans provided by Element Design (Attachment 4). The Landscaping
Plans identify the use of a Banksia Integrifolia as the feature tree at the frontage of the site and incorporates a
native landscaping palette.
This response represents our complete response to the Information Request issued by the Noosa Council, and
we look forward to the decision notice being issued by Council in accordance with the relevant provisions of the
Planning Act 2016.
As always, please feel free to contact me direct should you require any additional information or clarification.
Yours faithfully,

Dr David Johnson & Suzanne & Adam Johnson c/- Mr Michael Lyell Adams & Sparkes Town Planning and Development Brightwater Corporate Centre Level 1, 69 Attenuata Drive MOUNTAIN CREEK QLD 4557 Via email: - [email protected] 11 March 2018 Dear Michael, RE: 30 – 32 The Cockleshell, Noosaville Engineering Response to Information Request Please find below responses to the Noosa Council’s Information Request dated 10 January 2018 for the MCU at 30 – 32 The Cockleshell, Noosaville. Please be advised that the below responses and attachments are a response to information request items 7, 8 and 9 only. Application No: MCU17/0563 Proposal: Development Permit for Material Change of Use Street Address: 30 – 32 The Cockleshell, Noosaville Real Property Description: Lot 11 RP138550 and Lot 0 BUP6971 Planning Scheme: The Noosa Plan (3 July 2017) Issue The submitted stormwater drainage plans do not adequately address the impact of the development and the filling of the site on the drainage conditions on other properties. Information Required Item 7 Provide a stormwater strategy/layout that caters for the stormwater runoffs from adjoining properties and ensures no additional stormwater ponding or worsening of existing drainage conditions to occur on these properties for all storm events up and including 1% AEP (1 in 100 year). This may require providing stormwater pipeline and/or defined overland secondary flow path within the development site to convey natural stormwater runoff from other properties into an existing stormwater system.
Page 21
Response to Item 7
Skyline Surveyors were able to provide additional survey, spot level information, on some
areas of the neighbouring sites. This information is attached for Council’s record. Please
note that in some locations access was not possible and Skyline obtained as best survey
level information as possible. The survey information indicates the following: -
Lot CP BUP7701 appears to have a ridge through the middle of the site with the
western portion of the lot falling to the street and the eastern portion of the lot
falling to the rear of the site. Possible pond may occur in the north-eastern corner of
the proposed development site. In order to alleviate this possible ponding a side
grated pit is proposed in the base level of the retaining wall which will be connected
to the development site’s internal drainage. This stormwater system is shown on
amended 360 Civil Consulting Drawing No. 03 (Rev A).
Lot 6 RP124554 has an internal stormwater pit and overland flow discharges to
Thomas St via the existing driveway.
Lot CP BUP7283 is lower than the development site and the survey levels indicate it
falls towards Thomas St.
Lot CP BUP6949 appears to be slightly lower than the development site and falls
towards the street. The north-eastern corner of Lot CP BUP6949 appears to be
approximately at a similar level to the development site and to address any possible
ponding that may occur in this corner a side grated pit is proposed in the base level
of the retaining wall which will be connected to the development site’s internal
drainage. This stormwater system is shown on amended 360 Civil Consulting
Drawing No. 03 (Rev A).
Issue
Further information and details are required regarding the existing Council’s stormwater
pipeline within Lot 0 BUP 6971 (No 32 The Cockleshell Street).
Information Required Item 8
Provide further information, details and/or amendments to address the following:
a) The proposed development requires filling, increases load on the existing drainage
pipeline on the site and will limit future opportunities for repair and/or upgrade.
Also, there will be an increase in the flows in the pipeline due to the proposed
development. As such, it is considered necessary that CCTV investigation of the
existing pipeline (from The Cockleshell Street to Thomas Street) be carried out by the
applicant determine the condition of the pipeline and report of investigation
submitted to Council prior to issuing the OPW approval.
b) A drainage easement must be created by the applicant over the subject stormwater
pipeline at a width in compliance with Council’s standards and guidelines. Show the
required easement on the amended plans.
Response to Item 8
a) Please find attached to this response a preliminary stormwater CCTV report for the
existing 375mm stormwater pipe that runs through 32 The Cockleshell, Noosaville.
The CCTV commenced at The Cockleshell inlet pit and DrainsKleen have advised that
Page 22
"the survey was abandoned - camera travelled downstream about 7m, before
reaching, root mass which camera could not pass. Attempted reverse survey from
other end but unable to access pit."
The report and photos from DrainsKleen of the root mass is attached for council's
information. Further clarification from DrainsKleen regarding the reverse survey was
sought and the DrainsKleen operator who was on site has advised that: -
"I was unable to locate the downstream pit (unsure if downstream pit exists or is just
cut into another pipe). I am also unable to go from one of the neighbour pits on
Thomas Street as I can't go around corners with robot camera due to risk of
damaging equipment."
Since this survey, Council have advised that, in due course, they will unblock the
stormwater pipe and that no further work by this development is required in order
to address this information request item.
Reviewing the photographs provided in the DrainsKleen report the pipe that is visible
appears to be in a reasonable condition.
b) Please refer to the amended 360 Civil Consulting Drawing No. 03 (Rev 3) which
details the 4m wide drainage easement over the existing council stormwater
infrastructure.
Issue
Engineering plan/s is/are required for the details of the driveway grades and levels and
including a 2.0m wide pathway to confirm compliance with the relevant standard drawings
and for operational works construction.
Information Required Item 9
Provide an engineering plan and longitudinal cross section for the access driveway/s and
crossovers that include 2.0m wide pathway and demonstrates compliance with IPWEA
Standard Drawings RS-049 and RS-050 and have grades ensure a standard vehicle (B99),
entering or leaving the site will not scrape or bottom down.
Response to Item 9
Please refer to the amended 360 Civil Consulting Drawing No. 11 and 12 which detail a
driveway long section and relevant cross section drawings incorporating the 2m wide
footpath and compliance with IPWEA Drawings RS-049 and RS-050.
End of Responses to Information Request Items 7, 8 and 9.
