Submission Objecting to Application Reference MCU17/0076.01

1/25 Edward St, Noosaville, Qld 4566
Other change to include Short Term Accommodation (Multiple Housing Type 2 Duplex &
Operational Works)
Dear Sir
I refer to the above development application which is presently being publicly notified due to
being an impact assessable development. Noosa Shire Council is the assessment manager for
this development application.
I wish to object to this development application and request that the application be refused by
Council.
I am the owner of an adjoining dwelling and this dwelling is my permanent place of residence. I
have been a permanent resident of the Noosa EGA for the last ^ years.
Those grounds on which I have based my objection include, but are by no means limited to, the
following:
1. This adjoining premises located at 1/25 Edward Street, Noosaville, has been operating as a
short-term accommodation use for about the last 2 to 2.5 years. During this time, we have
been subjected to frequent partying and socialising within the adjoining premises by guests
who are staying in this premises for short periods of time and are clearly on holidays. Typically,
this socialising takes place on the outdoor deck at the rear of the adjoining premises, and
involves loud voices/fhe said partying occurs typically on multiple occasions per week and on
the majority of weeks per year.
2. The pool area is heavily used by the short- term accommodation renters, especially by those
with small children. It is not unusual for the pool to be used for 4+ hours every day during
short terms stays. Small children with loud and squealing voices can scream with joy, which in
turns significantly penetrates into adjoining dwellings. This disturbance of our quiet enjoyment
generally causes us to close windows and doors adjoining the short-term accommodation
property, and turn on our air-conditioning.
3. There appears to be a total lack of awareness and/or disregard by the guests and the owner of
this adjoining premises to the fact that this adjoining premises is located in a residential area.
4. Our home, like so many in the area, is constructed to enjoy the fresh air and breezes the
Noosa lifestyle provides. But on many occasions, this lifestyle is negatively impacted due to
excessive noise and loud voices from the adjoining short-term accommodation premise. At
night time, this disturbance forces us to retreat behind closed doors.

5. It is my understanding that the vast majority if not all adjoining residences to our immediate
property are owner occupied and not used for short term accommodation. The existing
residential amenity of the immediate neighbourhood is therefore one that has been enjoyed
by owner occupiers in the past. Over the last 2.5 years our immediate neighbourhood has
lost some of its valued residential amenity. The approval of the above development approval
will legitimise what has been happening to our immediate neighbourhood for the last 2.5
years from a land use perspective. The proposed local law may assist in providing an improved
means to lodging a complaint however many of the issues being experienced cannot be
negated by enforcing Council's local law.
It is considered that my grounds of objection cannot be adequately addressed by Council issuing
both a conditional approval of the above development application along with the requirement
for registration under Council's new local law on Short Stay Letting.
I therefore reiterate that the current application should be rejected for the above grounds
Yours sincerely

Detail: Hello,
We have received a letter from RG Strategic Noosa Heads regarding a changi
Unit 1 /23 Edward St, Noosaville for Short Term Letting.
Our property is behind the said unit and we live in Unit 6, 21 Ann St.
Our experience with the unit No2/ 23 Edward St next door has not been to d
a good experience and we haven’t complained.
i just hope that the new regulations will mean that holiday accommodation
residential areas will be better controlled in future.
It would be a great help if the managing agent could contact us and give son
assurances and contact details please.
Thank You,
Brian and Lynda Muir
