Submission of Change Representations
Representations on Decision Notice
Condition 8 – Services
Condition 8 states the following:
▪ Certification must be submitted to Council from all relevant service providers
(Energex, NBN and Unitywater) which certifies that the development has met the
requirements of this Decision Notice and all applicable legislation at the time of
construction.
In accordance with the Civil Servicing Statement, rainwater tanks have been proposed to
supply potable water to a future dwelling located on proposed Lot 2, and therefore no
water services connection is required. Also, the locality is not serviced by sewerage
infrastructure, and the Civil Servicing Statement has confirmed that an on-site
arrangement can be supported.
Accordingly certification is not required from Unitywater and it is recommended that
the reference to Unitywater in Condition 8 be removed. We request Condition 8 is
amended as follows:
▪ Certification must be submitted to Council from all relevant service providers
(Energex and NBN) which certifies that the development has met the requirements
of this Decision Notice and all applicable legislation at the time of construction.
Condition 9 – Easement
Condition 9 states the following:
▪ The terms of the existing access and services easement (Easement C in Lot 1 on
SP199340) must be amended to include Lots 1 & 2 as identified on the approved
plans and registered against all affected lots prior to Council signing the plan of
survey.
It is recommended that Condition 9 be removed because it is unnecessary and there is
no requirement under directions issued by Titles Queensland to amend the easement.
In accordance with the Registrar of Titles Directions for the Preparation of Plans 2025, the
allocation of benefit easements are carried forward onto new Titles (refer to extract of
Section 22.6.3 Benefit easements below). In this instance, the new Survey Plan will
allocate full benefit of existing Easement C in Lot 1 on SP199340 to proposed Lots 1 and
2.
