Attachment A
Decision Evidence and Findings
Findings on material questions of fact:
The objective of the Transport Infrastructure Act 1994 (TIA) requires a) the establishment of
a road regime that is safe and efficient.
Section 62 of the TIA provides for the Chief Executive of the Department of Transport and
Main Roads (the department) to make decisions about permitted road access locations
between particular land and a state-controlled road corridor.
The development application (Council reference: MCU22/0209) seeks a development permit
for a Material Change of Use of Short term accommodation.
The subject site has road frontage to Cooroy-Noosa Road, a local government road located
within the state-controlled road corridor of Cooroy-Noosa Road under jurisdiction of the
department.
The permitted access location is shown on Site Plan prepared by RJ Strategic dated 8
December 2022, reference 002622, Rev A.
Access to a local road outside of a state-controlled road corridor is not available.
The access location and standard proposed is suitable for the development.
The proposed development can be effectively implemented without significant impacts to the
safety and efficiency of the state-controlled road network with the conditioned access works,
location and standard.
