5.2 Assessment against the legislation

5.2.1 Council’s legislation

The site is located in the Rural Zone. A Material Change of Use for Dwelling House in Rural zone under
the Noosa Plan is considered an accepted development subject to requirements.

The site is mapped under the Biodiversity, Waterways and Wetlands Overlay Map, with the following
sub-categories: MSES Environmental values, Area of biodiversity significance, and Riparian buffer area
(Figure 3:). An assessment against the relevant provisions of the Biodiversity, Waterways and Wetlands
Overlay Code is technically not required because the overlay code is only applicable if vegetation within
the overlay is being removed or development is proposed within the Riparian Buffer area. The proposed
dwelling and associated bushfire management buffers do not require the removal of vegetation, and
they are not to be within the Riparian Buffer area, and therefore the code is not triggered. The access
driveway is also existing and no further clearing is required for this purpose.

5.2.2 State legislation

State Code 25: Development in South East Queensland koala habitat areas,

The site is not mapped in the Koala Priority Area (KPA) but it does contain mapped Koala Habitat Area
(KHA) (Koala Conservation Plan Map; administered by DES). However, the proposed house location
sis not within the KHA and therefore the application does not have to be referred to SARA and comply
with State Code 25: Development in South East Queensland koala habitat areas.
