10a building, or a deck associated with a Class 1 building constructed in a designated bushfire-prone area must provide
resistance to bushfires to reduce the danger to life and minimise the risk of loss to the building. Performance requirement H7P5
states that a Class 1 building or a Class 10a building or deck associated with a Class 1 building that is constructed in a
designated bushfire-prone area must be designed and constructed to:
▪ reduce the risk of ignition from a design bushfire with an annual exceedance probability of no more than 1:50
years;
▪ take account of the assessed duration and intensity of the fire actions of the design bushfire;
▪ be designed to prevent internal ignition of the building and its contents; and
▪ maintain the structural integrity of the building for the duration of the design bushfire.
The associated deemed to satisfy provision H7D4 to satisfy the NCC states that performance requirement H7P5 is satisfied when
a Class 1 building, or a Class 10a building or a deck associated with a Class 1 building, if it is constructed under:
▪ AS 3959; or
▪ NASH Standard – Steel Framed Construction in Bushfire Areas.
The proposed development outcome would include structures that constitute the following building classes under the NCC:
▪ Class 1a – a single dwelling, such as a detached house or one of a group of attached dwellings, including
townhouses, row houses, or the like.
As such, any Class 1a buildings constructed as a result of the proposed development will be required to conform to Part H7 of
the NCC.
4.4 Australian Standard 3959:2018
Australian Standard (AS) 3959:2018 (Construction of buildings in bushfire-prone areas) requires all new habitable structures
built in a bushfire-prone area to undergo a Bushfire Attack Level (BAL) assessment to determine the appropriate BAL
construction level. It is worth noting that detailed construction methods and materials are beyond the scope of this report, as
these details are typically addressed as part of a detailed building design certified under the Private Building Certification
provisions of the National Construction Code. However, the methods and standards in AS3959:2018 enable a best practice
method of adequately addressing bushfire risk mitigation during the development approval stage.
