1.2 SITE DESCRIPTION

The subject property is located at the south-eastern side of Lake Macdonald Drive
approximately 160 metres north-east of Swift Drive at Cooroy. The property contains
an area of 4.839ha.

The property is used as a rural residential premises with a single storey dwelling
house adjacent to the southern boundary and a shed adjacent to the Lake
Macdonald Drive frontage.

The property is undulating and generally slopes down to a point located centrally
along the Lake Macdonald frontage.

The property has been generally cleared of treed vegetation in the past.

Power and telephone services are connected and available to the property from the
Lake Macdonald Drive frontage.

Lake Macdonald Drive originally ran around the southern, eastern and north-eastern
side of the property. In the 1970’s Lake Macdonald Drive was constructed in its
current location and the original road reserve was closed and included in the subject
land.

Lake Macdonald Drive is a good quality bitumen road. Access to the property is via a
service road from Lake Macdonald Drive located at the northern end of the property
and a supplementary access is also located adjacent to the shed, which provide
ingress/egress to the local road network from the property.. The internal driveway

Page 3

from the service road to the house is located along the original road formation of
Lake Macdonald Drive.

Water supply pipelines are also located along the internal driveway and are
contained within Easement A on RP196432.

The adjacent properties range in area from 0.4ha to 3.1ha.

2. PROPOSAL

It is intended to carry out a Reconfiguration of the property to create 3 Lots as shown
on the Plan of Proposed Reconfiguration (Ref: 10-3018AF contained in Appendix B).

The proposed new Lot 11 at the northern end of the property is vacant and
comprises an area of 1.804ha. The existing service road access is proposed to be
used for access to the property.

The proposed new Lot 12 is located centrally along the Lake Macdonald Drive. The
proposed Lot is vacant and comprises an area of 1.52ha.

The proposed new Lot 13 at the southern end of the property contains the house and
shed and comprises and area of 1.512ha.

The proposed new Lots 12 and 13 gain access via a common driveway located
adjacent to the new common boundary; the new driveway is proposed to be
contained within and Easement for Access and Service. The new driveway location
has a sight distance in excess 130 metres.

Proposed Lots 11 and 12 have house site areas located as shown on the Plan of
Proposed Reconfiguration. Effluent disposal testing of the house site areas was
undertaken by Global Testing; the testing concludes that Lots are suitable for the on-
site disposal of effluent. The Effluent Disposal Reports are attached within Appendix
Cc

The existing electricity and telecommunication services located along the Lake
Macdonald Drive frontage will provide services to all Lots without extension of the
reticulation.

The proposed new Lots reflect the character of the local area.

3. STATUTORY ASSESSMENT — STATE GOVERNMENT
3.1 State Planning Regulatory Provisions
The site is included within the SEQ Regional Plan State Planning Regulatory

~-—Provisions.—-Land-Use Category of Rural Living Area; therefore, no-further..
assessment is required.

Page 4

3.2 Referral and State Development Assessment Provisions

A section of land located adjacent to the north-eastern boundary is mapped as Core
Koala Habitat Area. However, the development does not involve any inference with
the area, the area is all contained within Lot 11, house site areas are in excess of 50
metres from the mapped area and no operational works are proposed within the
area. It is considered that the application will require referral to SARA as a
concurrence agency.

3.3. State Planning Policies

The site is not mapped as being affected by any of the State Planning Policy's State
interest

4. NOOSA PLAN 2020
The subject lands are located in the Rural Residential Zone.

The subject lands are affected by the following Overlays of the Planning Scheme:

e Biodiversity: Area of Biodiversity Significance
Riparian Buffer
e Bushfire Hazard: Medium Potential Bushfire Intensity
Potential Impact Buffer
Extractive Resource: Local Resource Separation
Landslide Hazard Area: Moderate Hazard Area
High Hazard Area

e Regional Infrastructure Overlay: Water Supply Pipeline.

The above overlays do not affect the level of assessment of the application.

The proposal has been assessed against the relevant codes including: The Lot
Reconfiguration Code, the Rural Residential Zone Code, the relevant overlay codes
and the relevant development codes. The aspect of the codes that do not comply
with the Acceptable Solutions is discussed below.

4.1 Reconfiguring a Lot Code

It is considered that the proposal complies with the Overall Outcomes of the Planning
Scheme for the following reasons:

¢ The proposed lots are appropriate with the intended use and the character of
the local area.

+The proposed Lots are responsive to the site constraints.

Page 5

e The proposed Lots have services available and include safe access.

e The proposed lot areas comply with the minimum prescribed areas and
frontages prescribed in the Planning Scheme.

e The proposed Lots have a regular shape.
e No modification of the site is required.

e The proposal provides safe access to the road network of all Lots, without an
increase of number of access points.

e The proposal is a logical development of the property.

Overlay Codes

Specific Outcomes and Probable Solutions of Biodiversity, Waterways and
Wetlands Overlay Code

The new Lot boundaries created by the proposal transect areas cleared of treed
vegetation. The proposal has no impact upon the areas mapped as having
biodiversity significance, with the exception of a minor distance of the common
boundary between Lots 11 and 12 at the eastern end of the boundary.

This section of the boundary is generally clear of vegetation, as it is located at the
junction of 3 water supply pipelines and the existing driveway to the house (which is
the road formation of the original Lake Macdonald Drive).

A small section of the property located along the Lake Macdonald Drive frontage is
mapped as riparian buffer. This buffer is in relation to a water course located on the
opposite side of Lake Macdonald Drive. The formation and embankments of Lake
Macdonald Drive are located within the buffer area and they negate the values of the
land due to it being within the buffer area.

The proposal assists with the conservation of the sensitive areas and avoids any
fragmentation of the environmental values.

Specific Outcomes and Probable Solutions of Bushfire Hazard Overlay Code

The proposed Lot 11 contains an area designated as Moderate Bushfire Hazard
along the north-eastern boundary. The existing dwelling and the house site areas
are located outside of the hazard area and access to the road network is available for
the house site areas and the existing house. Therefore, the development does not
increase risk to people or increase the severity of any risks.

Page 6

Specific Outcomes and Probable Solutions of Extractive Resource Overlay
Code

The site is mapped as being contained within the Extractive Resource Overlay as
being within the Local Resource Separation Area. This is in relation a previous clay
resource located to the northwest of the site.

The mining licence of the clay deposit has been relinquished, the land rehabilitated
and developed as a rural residential development. It is considered that Extractive
Resource Overlay has no impact upon the development.

Specific Outcomes and Probable Solutions of Landslide Hazard Area Code

Parts of the site are mapped as being within the Moderate Hazard Area and a small
area adjacent to the shed is mapped as High Hazard Area. A significant part of the
site is mapped as being outside of the hazard areas.

The existing house and the proposed house site areas are located outside of the
hazard areas. Geotechnical testing of the stability of the house sites has been
undertaken by Global Testing; which concludes that the sites are suitable for the
construction of dwellings. The Geotechnical Reports of the testing are contained
within Appendix D.

The proposal is consistent with the Overall Outcomes Landslide Hazard Code.
Specific Outcomes and Probable Solutions of Regional Infrastructure Overlay
Code

Water pipelines traverse the property along the north-eastern, eastern and south-
eastern boundaries which supply water to the service reservoir of Cooroy. The

pipelines are located within an Easement for Services to benefit Unitywater.

The proposal does not impact upon the water supply infrastructure.

5. CONCLUSIONS

The planning assessment has been prepared to accompany a code assessable
application for a Development Permit for Reconfiguration of Lot 233 on MCH4301 to
create 3 Lots.

The assessment concludes that the proposal complies with, or with the imposition of
relevant conditions, the relevant provisions of the applicable codes in the Noosa Plan
2020; therefore,

Page 7

it is recommended that the application should be approved subject to reasonable
and relevant conditions of approval.
