Policy Author: Local Laws Coordinator
POLICY BACKGROUND
The purpose of this policy is to provide guidance to Noosa Councilss-ocalLaws—team— staff _for
managing and, where necessary, removing roadside memorials within Noosa Shire_in response to a
complaint or issues of safety and nuisance.-
Pursuant to section 2, Schedule 7 ‘Alteration or improvement to local government controlled areas and
roads’ of the Noosa Shire Council Subordinate Local Law No 1 (Administration) 2015, an approval is
| not required for an installation beside a road of a memorial ... comprising of a-white-cross_provided the
installation complies with the local government policy for the activity. The temporary placement of floral
tributes, plastic flowers and memorabilia at the memorial location is also acceptable. All roadside
memorials must comply with this policy.
POLICY
Council does not encourage the placement of roadside memorials within Council controlled road
reserves, but recognises that some members of the community may wish to temporarily commemorate
the passing of a loved one as a result of a road or other accident by installing a roadside memorial.
Council has provided the mechanism for members of the community to put in place a temporary
memorial without approval subject to the requirements specified in the local laws and this policy.
This policy has been developed to ensure that roadside memorials:
(a) Are placed in a safe location.
(b) Can be easily maintained.
(c) Do not cause issues for nearby property owners and users of the area.
(d) Do not create a hazard to road users, cyclists or pedestrians.
| The location of a roadside memorial should be selected to minimise the—risk-of-safety risks to all
persons and any interference to nearby properties and users of the surrounding area.
A roadside memorial must be located in a position where it will not:
(a) Distract driver attention or interfere with the role of any traffic control item.
(b) Be hazardous to passing traffic, cyclists and/or pedestrians, or prevent appropriate maintenance
of the road reserve.
(c) Cause interference with the nearby residences or users of the area.
Unless otherwise approved by way of formal application, all memorials (including floral tributes and
memorabilia) are to be temporary and thus remain in place for a maximum period of 3 months.
