site details
Background
The existing dwelling received building approval in 2001.
Site Description
The subject site comprises an area of 606m2 and is relatively flat. The subject site is free of native vegetation and an existing dwelling site in the centre of the property. Access to the site is provided from Weyba Rd, via a crossover driveway. It is also noted that the site is constrained by flooding which is represented by the Flooding and Inundation Extent on the Flood Hazard Overlay Map.
Surrounding Land Uses
The surrounding land uses of the subject site are varied and are comprised of the following:
North	Weyba Rd and Lake Weyba.
East Multiple Dwelling Units, South Pacific Resort, Noosa Art’s Theatre and the Noosa Australian Football Rules Club.
West Food and Drink Outlet, Multiple Dwelling Units, Offices, Food and Drink Outlets, Supermarket and Dwelling houses.
South	Dwelling houses.

Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
Noosa Plan 2020.
Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
Medium Density Residential Zone Code;
Noosaville Local Plan Code;
Dual Occupancy and Multiple Dwelling Code; and
Works Codes.
The subject site is located in Noosaville and is zoned Medium Density Residential. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below:

Setbacks
Side Setbacks
Acceptable Outcome AO12.1 of the Medium Density Residential Zone Code requires buildings and structures are setback 2.5 metres from the side boundaries where above 7.5 metres in height.
The proposed setback for the dual occupancy from the eastern and western side boundaries where above 7.5 metres in height is 2 metres. The proposal therefore does not comply with AO12.1 and is assessed against Performance Outcome PO12.
Performance Outcome PO12
Buildings and structures are designed and site to:
Provide a high level of amenity to users of the subject site and adjoining premises, including provision of visual and acoustic privacy;
not unreasonably obstruct views or cause overlooking of private open space or habitable areas of adjoining premises;
provide adequate distance from adjoining land uses;
preserve existing vegetation that will help buffer development;
allow for space and landscaping to be provided between buildings including adequate area at ground level for landscaping with trees, shrubs, outdoor living and utilities;
be consistent with the predominant character of the surrounding area; and
protect the natural character and avoid adverse impacts on ecologically important areas such as national parks, waterways and wetlands.
The side setback intrusions are highlighted in Figures 6 and 7 and comprise a minor section of the balcony roof. The minor setback intrusion maintains a consistent roofline along the front façade and provides a high level of amenity to users of the balcony by providing shade from the sun.
The minor setback intrusion does not contain windows or openings and therefore there is no opportunity for the overlooking of private open space or habitable areas of adjoining premises.
In addition, it is noted that the property to the west of the subject site is a food and drink outlet and does not include any habitable rooms. The minor setback encroachments are to a small section of the eastern and western boundaries and not the northern boundary of the adjoining property, thus the setback variation will not adversely affect access to sunlight for the adjoining properties.

Figure 6 – Side Setback Intrusions (North Elevation)

Figure 7 – Side Setback Intrusions (East & Wester Elevations)
Figure 8 demonstrates the proposed setback encroachments from a bird’s eye view. Moreover, Figure 8 highlights the 1.5-metre-wide landscaped area for 2.4 metres of the 3 metre long roof, whilst the remaining 0.6 metre long area is 0.6 metres wide. In order to ensure adequate landscaping is planted in this area a condition has been included requiring a minimum 0.6-metre-wide garden to the eastern and western boundary fence must be densely landscaped. Screening plant species are to be planted at a maximum of 1.5m centres and have a 200mm pot size. The screening trees must grow to a minimum mature height of 4m along the entire length. The proposed setback variations are considered to allow for space and landscaping to be provided between buildings. The application therefore complies with Performance Outcome PO12.

Figure 8 – Side Setback Intrusions (Roof Pan)

Landscape Code
Relevant outcomes sought by the Landscape code but not met includes ‘Landscaping is consistent with the vegetated character and landscape design principles of Noosa Shire’. The plant species selected includes a number of exotic species and species not endemic (or from the Noosa Preferred Plant List) (Performance Outcome PO10). This does not meet the requirements for being consistent with the vegetated character of the Noosa Shire. Performance Outcome PO3 and PO4 requires street trees with the applicant identifying within the application material for street trees to be conditioned. The Landscaping Code performance outcomes requires buffer and screening planting to enable the development to sit within the vegetation and screen and buffer hard surfaces. Some areas of the development does not include appropriate vegetated screening from neighbouring properties including the rear boundary with the pools located against the fence with no soft landscaping.
