Dear Sir/Madam,
Please find following my submission opposing the proposed development MCU24/0084 and the
reasons why.
POLLUTION:
The current site is comparatively pollution free to that which has been proposed in the development
material change of use. The change will introduce pollution in many forms including the following:
LIGHT POLLUTION:
Light pollution has negative effects on human health and more significantly in these circumstances
on the survival of wildlife, including impacting on an animals’ ability to feed, hunt, forage, mate and
move about.

The proposed hours of operation of the onsite event venue will be from 11am to 11pm everyday of
the year. From sunset until 11pm the operation will be conducted in the hours of darkness, resulting
the use of artificial light to illuminate the site and the event venue. The vehicles accessing the site
will also be using artificial light to illuminate their way as they navigate to and from the event venue
located way down the rear by the dam.
Light pollution will also be generated by vehicles travelling to and from the site along public roads,
e.g. Louis Bazzo Drive, McKinnon Drive and all connecting feeder roads.
Plants and animals depend on Earth’s daily light and dark cycle to govern life-sustaining behaviours.
Research shows that artificial light at night has adverse and even deadly effects on many species.
The site, surrounding properties and area is home to many species that will be threatened.
NOTE: Several areas on site near the venue are designated Core Koala Habitat Areas and
neighbouring properties have designated Core Koala Habitat Areas and the greater area is classified
Koala Priority Area.
NOISE POLLUTION:
Noise pollution is the spread of unwanted sounds into the environment.
Noise is classified as a health hazard and can have a significant impact on the well-being of humans
and animals.
The Material Change of Use proposal will allow light and heavy vehicle access to the site 24/7 every
day of the year for staff and suppliers e.g. kitchen staff, catering, waste disposal, organisers,
providores, cleaners, groundsman. During the hours of operation for the event venue, 11am to 11pm
every day of the year and in addition to the aforementioned, the proposal will allow access to the
site for 150 guests and 12 staff, with parking for 61 vehicles including 2 coaches. The number of
vehicle movements across the site will be a significant increase to that which is current at the
Macadamia Orchard.
The proposal for the venue is to primarily host weddings. Weddings are parties, parties are
notoriously noisy. Weddings are usually accompanied by a band or DJ, hosted by a Master of
Ceremonies controlling the event over a public address system, add 150 guests all trying to make
their voice heard, alcohol and the components for noise generation are assembled and activated
with permission being sought to run for 12 hours every day.
Another contributor to the noise on site will be the power generator.
Noise in the country travels a greater distance unimpeded when compared to urban areas, the
residents in neighbouring and nearby properties will be impacted, windows will have to be secured
closed to try and reduce unwanted sounds in their homes. What was a peaceful rural existence living
near a Macadamia Orchard will be lost.
The increase in vehicle movements, wedding and human activities will result in an increase in noise
and noise duration and will be a threat to the natural noises and peaceful environment that currently
exists. Impacting on the health and well-being of residents in adjoining and nearby properties and

their animals and to the well-being and survival of wildlife on site and in neighbouring properties and
nearby area.
AIR POLLUTION:
The network of roads and parking areas on the site are unsealed, the increase in light and heavy
vehicle movements, dust generated and the vehicle exhaust emissions will impact on the health and
well-being of residents their animals and wildlife onsite and in the neighbouring properties.
Roof catchments will be contaminated affecting drinking water quality and particulates in the air
could cause respiratory issues.
All possessions outdoors will be covered in dust, including the house, dams, outbuildings, cars and
even the plants and trees. The residents will not be able to dry their laundry outdoors. Windows will
have to be secured closed to prevent dust ingression.
WATER POLLUTION:
This Material Change of Use has not included an onsite greywater management system.
BUSHFIRE:
Human activity is a known to be a major cause of bush fires.
The site has a large area of High Potential Bushfire Intensity and is surrounded by properties with
High Potential Bushfire Intensity.
This Material Change of Use will have a significant increase in human activity on site and with that
comes and increased risk of bushfire, endangering people, animals, wildlife and causing damage or a
loss of property.
ACCESS ROADS:
The site is located in a quiet rural area, 24 km from Noosa, 17.5 km from Tewantin and 8.4 km from
Pomona.
The site is accessed from Pomona along Louis Bazzo Drive and from Noosa/Tewantin along McKinnon
Drive connecting with Louis Bazzo Drive
Travelling on these roads should be avoided at dawn, dusk and late at night, due to high level of
wildlife that lives along these routes, locals and country people know and respect this as a condition
of country living to protect wildlife.
This Material Change of Use requires service vehicle access 24/7 and venue operating hours, 11am to
11pm every day, poses a high risk to wildlife being killed or injured.
PARKING:

Page 5
Inadequate staff parking spaces.
This Material Change of Use claims the venue will be operating with 5-12 staff but only provides 4
staff carparking spaces.
SAFETY:
More than 100 people drowned in dams in Australia in the past ten years, new data released by the
Royal Life Saving Society – Australia found.
The data was drawn from coronial reports and compiled as part of Farm Safe Week to highlight the
risks to people living and working on properties with dams, rivers or other water bodies.
This Material Change of Use is for a venue to be constructed on a rural property alongside a large
dam with a jetty pontoon and conduct events with up to 162 people onsite, the venue will be
operating in the hours of darkness, serving alcohol and playing load music (preventing the cries for
help being heard).
WILDLIFE/ENVIRONMENTAL:
The site has been identified with Matters of State Environmental Significance (MSES) to aid in the
protection of biodiversity, includes Core Koala Habitat Areas.
The impacts of the Material Change of Use including Light, Noise, Air and Water pollution previously
raised pose a significant threat to wildlife and the environment.
The requirement for the development to be designed and operated to maintain and enhance
connectivity between and across ecologically important areas and connecting habitat and support
unimpeded and safe movement of terrestrial and aquatic fauna has not been achieved.
Some of the issues: the development will see the site dissected by a series of roads used frequently
day and night, the site has already been dissected by a newly constructed series of fenced paddocks
with reason and use unspecified, the proximity of the wedding venue to the dam impedes animals
access to drinking water, the jetty pontoon dissects the riparian zone, the location of the internal
road on site leading to the wedding venue presents a risk to wildlife as vehicles will be driving
along/within the boundary of the Core Koala Habitat Area.
NOTE: The Town Planning Report provide by Blackburne Jackson, Biodiversity Overlay shows the
boundary of the dam beyond the riparian zone in the area of the proposed construction site, this
conflicts with the information contained in Noosa Councils Overlay Maps which show the dam with a
significant riparian zone at the same location. Has this construction encroached on the riparian zone.
COMPATIBILITY:
This Material Change of Use does not pass the requirements for compatibility with the existing land
use.
Land uses in the Rural zone are limited to those which are compatible with agriculture and the
protection of environmental and landscape values.

The strategic framework for Noosa Shire has exceptionally high biodiversity and is a stronghold for a
wide range of regional ecosystems that includes threatened species. This Material Change of Use is
not keeping within this framework and potentially cause harm.
This proposal fails to comply with all the assessment benchmarks relevant to the land use occurring
in a rural zone.
LOSS OF AMENITY:
The Town Planning Report for MCU24/0084 claims the proposal will not affect the area’s amenity.
This claim cannot be validated and has proposed many changes harmful to the area’s amenity,
changes that I have identified and raised in this submission.
PRIVACY/SECURITY:
This Material Change of Use proposal, brings many strangers into the area, creating privacy and
security issues for the neighbouring properties and the greater Ringtail Creek Community.
PROPERTY VALUES:
This Material Change of Use proposal will have detrimental effects on real estate values in the
Ringtail Creek area surrounding the proposed site.
CONCLUSION:
Approval of Material Change of Use MCU24/0084 should not be provided for the reasons identified
in this submission, approval will create a harmful precedent for Noosa Shire.
